Amending O. Reg. 243/02
(Licensing Powers)
1. Section 7 of Ontario Regulation 243/02 is revoked and the following substituted:
Real estate
7. A municipality does not have the power under Part IV of the Act to establish a registry for or to license, regulate or govern any of the following:
1. The business of trading in real estate, as the terms “real estate” and “trade” are defined in section 1 of the Real Estate and Business Brokers Act, 2002.
2. A person registered under the Real Estate and Business Brokers Act, 2002 who is carrying on business as a broker, salesperson or brokerage, as “broker”, “salesperson” and “brokerage” are defined in section 1 of that Act.
2. (1) Subject to subsection (2), this Regulation comes into force on the day subsection 4 (1) of Schedule C to the Consumer Protection Statute Law Amendment Act, 2002 comes into force.
(2) If this Regulation is filed after the day subsection 4 (1) of Schedule C to the Consumer Protection Statute Law Amendment Act, 2002 comes into force, this Regulation comes into force on the day it is filed.
