Amending O. Reg. 268/18

(GENERAL)

1. Section 12 of Ontario Regulation 268/18 is amended by adding the following subsection:

(2) Where this Regulation requires a sign to be a copy of a sign accessible through a website of the Government of Ontario, it is sufficient to copy the information and informational symbols on such a sign without copying a Trillium or “Smoke-Free” logo in an exact fashion, or copying it at all.

2. (1) Paragraph 2 of subsection 14 (2) of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

(2) Paragraph 2 of subsection 14 (3) of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

(3) Paragraph 2 of subsection 14 (4) of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

(4) Paragraph 2 of subsection 14 (5) of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

3. Paragraphs 1, 2 and 3 of section 15 of the Regulation are revoked and the following substituted:

1. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco Sign for Employers”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

2. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Electronic Cigarette Sign for Employers”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

3. A sign that,

i. is at least 15 centimetres in height and at least 20 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco and Electronic Cigarette Sign for Employers”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

4. Paragraphs 1, 2 and 3 of section 16 of the Regulation are revoked and the following substituted:

1. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco Sign for Proprietors”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

2. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Electronic Cigarette Sign for Proprietors”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

3. A sign that,

i. is at least 15 centimetres in height and at least 20 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco and Electronic Cigarette Sign for Proprietors”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

5. Paragraphs 1, 2 and 3 of section 17 of the Regulation are revoked and the following substituted:

1. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco Sign for Hotels, Motels and Inns”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

2. A sign that,

i. is at least 10 centimetres in height and at least 10 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Electronic Cigarette Sign for Hotels, Motels and Inns”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

3. A sign that,

i. is at least 15 centimetres in height and at least 20 centimetres in width, and

ii. includes the information and informational symbols on the sign entitled “Tobacco and Electronic Cigarette Sign for Hotels, Motels and Inns”, dated November 1, 2019 (effective January 1, 2020) and accessible through a website of the Government of Ontario.

6. (1) Subparagraph 1 ii of section 18 of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

(2) Subparagraph 2 ii of section 18 of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

7. Subsections 20 (2) and (3) of the Regulation are revoked and the following substituted:

(2) Despite the definition of “tobacconist” in subsection 1 (1), a retail establishment that registered as a tobacconist with the board of health for the place where it is located before January 1, 2020 continues to be a tobacconist for the purposes of this section if,

(a) at the time of registering with the board of health, at least 50 per cent of the establishment’s inventory consisted of specialty tobacco products; and

(b) during every 12-month period after registering, at least 50 per cent of the establishment’s total sales for the previous 12 months consists of specialty tobacco products.

8. Paragraph 2 of subsection 26 (4) of the Regulation is amended by striking out “January 1, 2018” and substituting “November 1, 2019 (effective January 1, 2020)”.

9. The following provisions of Ontario Regulation 15/19 are revoked:

1. Subsection 1 (2).

2. Subsection 2 (2).

Commencement

10. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Sections 1 to 8 come into force on the later of January 1, 2020 and the day this Regulation is filed.
