Amending O. Reg. 167/95
(GENERAL)
1. Section 26.1 of Ontario Regulation 167/95 is revoked and the following substituted:
26.1 (1) In this section,
“2009 Manual” means the Forest Management Planning Manual dated November, 2009 and referred to in subsection (4);
“2017 Manual” means the Forest Management Planning Manual dated March 2017 and referred to in subsection (4);
“2020 Manual” means the Forest Management Planning Manual dated May, 2020 and approved under subsection (2).
(2) The Forest Management Planning Manual prepared by the Ministry under paragraph 1 of subsection 68 (1) of the Act and dated May, 2020 is approved.
(3) The 2020 Manual applies to,
(a) forest management plans with effective dates that are on or after April 1, 2023; and
(b) forest management plans with effective dates that are on or after December 10, 2009 and before April 1, 2023, subject to subsections (4) to (6).
(4) The two Forest Management Planning Manuals prepared by the Ministry under paragraph 1 of subsection 68 (1) of the Act, dated November, 2009 and March, 2017 respectively and previously approved under this Regulation continue to apply to forest management plans with effective dates that are on or after December 10, 2009 but before April 1, 2023, subject to subsections (5) and (6).
(5) The 2009, 2017 and 2020 Manuals apply to forest management plans with effective dates that are on or after December 10, 2009 and before April 1, 2018 in accordance with the following rules:
1. The 2009 Manual applies to the plans, subject to the phase-in provisions set out in the 2017 Manual and the 2020 Manual.
2. The 2017 Manual applies to the plans in accordance with the phase-in provisions set out in that Manual but subject to the phase-in provisions set out in the 2020 Manual.
3. The 2020 Manual applies to the plans in accordance with the phase-in provisions set out in that Manual.
(6) The 2017 and 2020 Manuals both apply to forest management plans that have effective dates that are on or after April 1, 2018 but before April 1, 2023 in accordance with the following rules:
1. The 2017 Manual applies to the plans subject to the phase-in provisions set out in the 2020 Manual.
2. The 2020 Manual applies to the plans in accordance with the phase-in provisions set out in that Manual.
2. Section 26.2 of the Regulation is amended by striking out “March, 2017” and substituting “May, 2020”.
3. Section 27 of the Regulation is amended by striking out “March, 2017” and substituting “May, 2020”.
4. Section 28 of the Regulation is amended by striking out “October, 2017” and substituting “May, 2020”.
Commencement
5. This Regulation comes into force on the later of July 1, 2020 and the day it is filed.
