Amending O. Reg. 187/09

(GENERAL)

1. Ontario Regulation 187/09 is amended by striking out “Real Estate and Business Brokers Act, 2002” wherever it appears and in each case substituting “Trust in Real Estate Services Act, 2002”.

2. The Table to section 1 of the Regulation is amended by revoking the following items:

 

Technical Standards and Safety Act, 2000

all provisions except for sections 33, 34 and 35 and subsections 36 (1), (2) and (5)

the regulations made under the Technical Standards and Safety Act, 2000

all provisions

 

3. Section 2 of the Regulation is revoked and the following substituted:

Electricity Act, 1998

2. For the purposes of subsection 3 (2) of the Act, the Electrical Safety Authority, that is incorporated under the laws of the Province of Ontario by letters patent dated January 12, 1999 and with which the Minister of Consumer and Business Services entered into an administrative agreement dated March 11, 1999, is designated as the sole administrative authority for the purpose of administering the provisions of the Electricity Act, 1998 and the regulations made under that Act that are designated legislation under section 1.

4. Section 2.2 of the Regulation is revoked and the following substituted:

Funeral, Burial and Cremation Services Act, 2002

2.2 For the purposes of subsection 3 (2) of the Act, the Bereavement Authority of Ontario, that is incorporated under the laws of the Province of Ontario by letters patent dated July 24, 2014 and with which the Minister of Government and Consumer Services entered into an administrative agreement dated August 6, 2015, is designated as the sole administrative authority for the purpose of administering the provisions of the Funeral, Burial and Cremation Services Act, 2002 and the regulations made under that Act that are designated legislation under section 1.

5. Section 4 of the Regulation is revoked and the following substituted:

Real Estate and Business Brokers Act, 2002

4. For the purposes of subsection 3 (2) of the Act, the Real Estate Council of Ontario, that was incorporated under the laws of Canada by letters patent dated January 24, 1997 and continued under the laws of the Province of Ontario on June 9, 2021 and with which the Minister of Consumer and Commercial Relations entered into an administrative agreement dated March 1, 1997, is designated as the sole administrative authority for the purpose of administering the provisions of the Real Estate and Business Brokers Act, 2002 and the regulations made under that Act that are designated legislation under section 1.

6. Section 5 of the Regulation is revoked.

7. The following provisions of the Regulation are amended by striking out “for the purposes of section 4 of the Act” wherever it appears:

Commencement

8. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Section 1 comes into force on the later of the day section 1 of the Trust in Real Estate Services Act, 2020 comes into force and the day this Regulation is filed.
