Amending O. Reg. 78/12

(GENERAL)

1. (1) Subsection 21 (1) of Ontario Regulation 78/12 is amended by striking out the portion before paragraph 1 and substituting the following:

Prohibition re minors

(1) For the purposes of subsection 2 (2) of the Act, the following are prescribed as documentation of age of an individual purchasing a lottery ticket:

(2) Clause 21 (2) (b) of the Regulation is revoked and the following substituted:

(b) upon claiming a prize, the individual presents one of the forms of identification listed in subsection (1), the identification provided indicates that the individual is at least 18 years of age and there is no apparent reason to doubt the authenticity of the documentation or to doubt that it was issued to the individual producing it.

(3) Section 21 of the Regulation is amended by adding the following subsections:

(3) Subsections 2 (1) and (2) of the Act do not apply to a person who is authorized to sell lottery tickets, or a person acting on such a person’s behalf, who sells a lottery ticket to an individual through a self-serve terminal that exclusively sells lottery tickets if,

(a) at the point of sale, the individual purchasing the lottery ticket provides to the self-serve terminal one of the forms of identification listed in subsection (1), the identification provided indicates that the individual is at least 18 years of age and there is no apparent reason to doubt the authenticity of the documentation; and

(b) upon claiming a prize, the individual presents one of the forms of identification listed in subsection (1), the identification provided indicates that the individual is at least 18 years of age and there is no apparent reason to doubt the authenticity of the documentation or to doubt that it was issued to the individual producing it.

(4) The condition in clause (3) (b) that there be no apparent reason to doubt that the documentation was issued to the individual producing it does not apply with respect to a prize, or to a portion of a prize, that is claimed through the self-serve terminal in the form of one or more lottery tickets.

(5) For greater certainty, subsections (3) and (4) shall not be read as limiting any power of the Registrar under section 3.8 of the Act to establish standards and requirements with respect to how prizes may or must be claimed.

Commencement

2. This Regulation comes into force on the later of July 1, 2023 and the day this Regulation is filed.
