Amending O. Reg. 14/18

(ONTARIO ELECTRICITY SUPPORT PROGRAM)

1. Ontario Regulation 14/18 is amended by adding the following section:

Limitation period

12. (1) The limitation period applicable to rate-assisted consumers for the purposes of subsection 79.2 (10.1) of the Act is 24 months after the date of issuance of the invoice in which the rate protection was not provided to the rate-assisted consumer.

(2) The limitation period applicable to a licensed distributor, including a host distributor, or a unit sub-meter provider for the purposes of subsection 79.2 (10.1) of the Act is six months after the earliest date when the distributor or unit sub-meter provider could have submitted a claim for reimbursement for an amount of rate assistance that the licensed distributor or unit sub-meter provider provided to a rate-assisted consumer.

(3) In the event of a conflict between a limitation period referred to in subsection (2) and a limitation period provided for in section 36.1.1 of the Electricity Act, 1998, the limitation period that provides the longest time period for a claim to be made prevails.

Commencement

2. This Regulation comes into force on the later of July 1, 2023 and the day this Regulation is filed.
