Amending Reg. 965 of R.R.O. 1990

(HOSPITAL MANAGEMENT)

1. (1)  The French versions of the definitions of “nurse” and “registered nurse in the extended class” in subsection 1 (1) of Regulation 965 of the Revised Regulations of Ontario, 1990 are revoked.

(2)  The French version of subsection 1 (1) of Regulation 965 of the Revised Regulations of Ontario, 1990 is amended by adding the following definitions :

«infirmière autorisée ou infirmier autorisé de la catégorie supérieure» S’entend :

a)  soit d’un membre de l’Ordre des infirmières et infirmiers de l’Ontario qui est une infirmière autorisée ou un infirmier autorisé et qui est titulaire d’un certificat d’inscription de la catégorie supérieure délivré sous le régime de la Loi de 1991 sur les infirmières et infirmiers,

b)  soit d’une personne qui est soustraite à l’application des paragraphes 11 (1) et (5) de la Loi de 1991 sur les infirmières et infirmiers par un règlement pris en vertu de cette loi et qui est titulaire, dans une autre province ou un territoire du Canada, de l’équivalent d’un certificat d’inscription de la catégorie supérieure pour les infirmières autorisées et infirmiers autorisés en Ontario. («registered nurse in the extended class»)

«infirmière ou infirmier» S’entend :

a)  soit d’un membre de l’Ordre des infirmières et infirmiers de l’Ontario qui est une infirmière autorisée ou un infirmier autorisé,

b)  soit d’une personne qui est soustraite à l’application des paragraphes 11 (1) et (5) de la Loi de 1991 sur les infirmières et infirmiers par un règlement pris en vertu de cette loi et qui est titulaire, dans une autre province ou un territoire du Canada, de l’équivalent d’un certificat d’inscription de la catégorie générale ou à la catégorie supérieure pour les infirmières autorisées et infirmiers autorisés en Ontario. («nurse»)

(3) The definition of “nurse” in subsection 1 (1) of Regulation 965 of the Revised Regulations of Ontario, 1990 is revoked and the following substituted:

“nurse” means,

(a)  a member of the College of Nurses of Ontario who is a registered nurse, or

(b)  a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds, in another Canadian jurisdiction, the equivalent of a certificate of registration in the general or extended class for registered nurses in Ontario; (“infirmière ou infirmier”)

(4) The definition of “registered nurse in the extended class” in subsection 1 (1) of the Regulation is revoked and the following substituted:

“registered nurse in the extended class” means,

(a)  a member of the College of Nurses of Ontario who is a registered nurse and who holds an extended certificate of registration under the Nursing Act, 1991, or

(b)  a person who is exempted from subsections 11 (1) and (5) of the Nursing Act, 1991 by a regulation made under that Act and who holds, in another Canadian jurisdiction, the equivalent of a certificate of registration in the extended class for registered nurses in Ontario; (“infirmière autorisée ou infirmier autorisé de la catégorie supérieure”)

2. The Regulation is amended by adding the following section:

1.1 (1) Subject to subsection (2), for the purposes of the Act and this Regulation, a “physician” includes a person who is exempted from subsections 9 (1) and (3) of the Medicine Act, 1991.

(2) For the purposes of section 37 of the Act, a “physician” also includes a person who meets all of the requirements in a regulation made under the Medicine Act, 1991 to be exempted from subsections 9 (1) and (3) of that Act, except for the requirement to provide professional services in a public hospital, the University of Ottawa Heart Institute or a long-term care home.

Commencement

3. This Regulation comes into force on the later of the day subsection 12 (1) of Schedule 2 to the Your Health Act, 2023 comes into force and the day this Regulation is filed.
