Amending O. Reg. 271/09

(FAIR REGISTRATION PRACTICES)

1. Section 1 of Ontario Regulation 271/09 is amended by adding the following definition:

“teachers’ qualifications regulation” means Ontario Regulation 176/10 (Teachers’ Qualifications) made under the Act. (“règlement sur les qualifications requises pour enseigner”)

2. Paragraph 5 of section 2 of the Regulation is revoked and the following substituted:

5.  That the Registrar will make a decision about whether to issue a certificate in accordance with the timelines set out in subsection 3 (4) of this Regulation after receiving all of the following:

i.  The application for a certificate.

ii.  Payment of all fees required under the by-laws for the issuance of the certificate.

iii.  All required supporting documents and evidence, to the satisfaction of the Registrar.

3. Section 3 of the Regulation is revoked and the following substituted:

3. (1) Upon receiving the items mentioned in subparagraphs 5 i and ii of section 2, the Registrar shall give the applicant a written notice acknowledging receipt.

(2) Upon receiving the items mentioned in subparagraph 5 iii of section 2, the Registrar shall give the applicant a written notice acknowledging receipt.

(3) After giving the applicant the written notice mentioned in subsection (2), the Registrar shall take one of the following actions in accordance with subsection (4):

1.  Issue the certificate without terms, conditions or limitations.

2.  Issue the certificate with terms, conditions or limitations to which the applicant has consented.

3.  Give notice in accordance with subsections 20 (1) to (3) of the Act of a proposal by the Registrar to refuse to issue a certificate of qualification and registration or to issue the certificate with terms, conditions or limitations to which the applicant has not consented.

(4) The Registrar shall take one of the actions set out in subsection (3) in accordance with the following rules:

1.  In the case of an application received under section 4 of the teachers’ qualifications regulation, the Registrar shall take one of the actions forthwith, unless the Registrar determines there are exceptional circumstances that prevent the Registrar from doing so.

2.  In the case of an application received under section 5 of the teachers’ qualifications regulation, the Registrar shall take one of the actions within the timeline set out under subsection 9.1 (4) of the Fair Access to Regulated Professions and Compulsory Trades Act, 2006, unless an exemption has been granted under section 9.2 of that Act.

3.  In the case of an application received under section 6, 6.1 or 6.2 of the teachers’ qualifications regulation, the Registrar shall take one of the actions within 60 business days, unless the Registrar determines there are exceptional circumstances that prevent the Registrar from doing so.

4. This Regulation comes into force on the later of December 31, 2023 and the day this Regulation is filed.
