Amending O. Reg. 509/18

(ENERGY AND WATER EFFICIENCY - APPLIANCES AND PRODUCTS)

1. Subsection 1 (1) of Ontario Regulation 509/18 is amended by adding the following paragraph:

9.  The appliances and products governed by the Energy Efficiency Regulations (Canada) to which Schedule 9 to this Regulation applies.

2. (1) Subsection 2 (2) of the Regulation is amended by striking out “Section 1 of each Schedule sets out” at the beginning and substituting “Section 1 of each Schedule, other than Schedule 9, sets out”.

(2) Section 2 of the Regulation is amended by adding the following subsection:

(2.0.1) Section 1 of Schedule 9 sets out the following information with respect to the prescribed efficiency standard or requirement for an appliance or product:

1.  A description of the appliance or product to which the efficiency standard or requirement applies.

2.  The period during which the particular appliance or product must have been manufactured in order for the efficiency standard or requirement to apply.

3.  The testing and energy efficiency standards and requirements applicable to the appliance or product.

3. Section 4 of the Regulation is amended by adding the following subsection:

(3) This section does not apply with respect to Schedule 9.

4. Section 5 of the Regulation is amended by striking out “in section 1 of a Schedule to this Regulation” and substituting “in section 1 of Schedule 1 to 8”.

5. Section 1 of Schedule 2 to the Regulation is amended by striking out “or later” wherever it appears and substituting in each case “to December 31, 2024 inclusive”, except in the following provisions:

1.  Subparagraph 14 i.

2.  Subparagraph 15 i.

3.  Subparagraph 16 i.

6. (1) Paragraphs 16.1, 18.1, 21.1, 22.1 and 23.1 of section 1 of Schedule 3 to the Regulation are revoked.

(2) The following provisions of section 1 of Schedule 3 to the Regulation are amended by striking out “or later” wherever it appears and substituting in each case “to December 31, 2024 inclusive”:

1.  Subparagraph 4.2 i.

2.  Subparagraph 10 i.

3.  Subparagraph 11 i.

4.  Subparagraph 14.1 i.

5.  Subparagraph 24 i.

6.  Subparagraph 28.2 i.

7.  Subparagraph 29 i.

7. (1) Subparagraph 8 i of section 1 of Schedule 6 to the Regulation is amended by striking out “or later” at the end and substituting “to December 31, 2023 inclusive”.

(2) Subparagraphs 8 ii to iv of section 1 of Schedule 6 to the Regulation are amended by striking out “CSA C802.1” wherever it appears and substituting in each case “CSA C802.1-13”.

(3) Section 1 of Schedule 6 to the Regulation is amended by adding the following paragraph:

9.  Transformer, liquid-filled, distribution, 60 Hz, rated at 10 to 833 kVA for single-phase or at 15 to 3000 kVA for three-phase, insulation class 34.5 kV and less:

i.  Date of manufacture: January 1, 2024 or later.

ii.  Testing standard: either,

A.  U.S. DOE 10 Code of Federal Regulations Part 431, Subpart K, §431.193 Test procedures for measuring energy consumption of distribution transformers, as it read on the date the particular appliance or product is manufactured, or

B.  CSA C802.1, Minimum efficiency values for liquid-filled distribution transformers, as it read on the date that is 12 months before the date the particular appliance or product is manufactured.

iii.  Scope of application: If using the testing standard described in subparagraph ii A, a “liquid-immersed distribution transformer” as defined in U.S. DOE 10 Code of Federal Regulations Part 431, Subpart K, §431.192 Definitions, as it read on the date the particular appliance or product is manufactured. If using the testing standard described in subparagraph ii B, the same scope as CSA C802.1, as it read on the date that is 12 months before the date the particular appliance or product is manufactured.

iv.  Prescribed efficiency standard or requirement: if using the testing standard described in subparagraph ii A, U.S. DOE 10 Code of Federal Regulations Part 431, Subpart K, §431.196 Energy conservation standards and their effective dates, as it read on the date the particular appliance or product is manufactured; or, if using the testing standard described in subparagraph ii B, the minimum efficiency values for distribution transformers specified in CSA C802.1, as it read on the date that is 12 months before the date the particular appliance or product is manufactured.

8. The Regulation is amended by adding the following Schedule:

EFFICIENCY STANDARDS AND REQUIREMENTS

1. In this Schedule,

“Energy Efficiency Regulations (Canada)” means, with respect to a particular appliance or product, the Energy Efficiency Regulations, 2016 (SOR/2016-311) made under the Energy Efficiency Act (Canada), as they read on the date the appliance or product is manufactured.

2. (1) This Schedule applies with respect to an appliance or product listed in Column 1 of Table 1 to this Schedule if it was manufactured during the period indicated for the appliance or product in Column 2 of the Table.

(2) For the purposes of subsection (1), a reference in Column 1 of Table 1 to this Schedule to an appliance or product is a reference to that appliance or product within the meaning of the Subdivision of Part 2 of the Energy Efficiency Regulations (Canada) that is specified in Column 3 of the Table for the appliance or product.

3. (1) The prescribed efficiency standards and requirements for an appliance or product to which this Schedule applies are the testing and energy efficiency standards and requirements applicable to the appliance or product that are set out in the Subdivision of Part 2 of the Energy Efficiency Regulations (Canada) that is specified in Column 3 of the Table for the appliance or product.

(2) For greater certainty,

(a)  if a testing or energy efficiency standard or requirement included in a Subdivision specified in Column 3 for an appliance or product is limited to a class of the appliance or product, the standard or requirement applies only with respect to that class; and

(b)  if Column 1 sets out a class of appliance or product, the testing and energy efficiency standards and requirements specified in Column 3 apply only with respect to that class, even if they are expressed more broadly.

9. This Regulation comes into force on the later of January 1, 2024 and the day this Regulation is filed.
