Amending O. Reg. 354/16

(GENERAL)

1. Section 1 of Ontario Regulation 354/16 is amended by striking out “Tables 1, 2, 3, 3.1, 4 and 5” and substituting “Tables 1, 2, 3, 3.1, 3.2, 4 and 5”.

2. The English version of subsection 9 (1) of the Regulation is amended by striking out “to not apply” and substituting “do not apply”.

3. Paragraph 1 of subsection 9.1 (2) of the Regulation is revoked and the following substituted:

1.  Red Swamp Crayfish (Procambarus clarkii) of the genus Procambarus.

2.  Signal Crayfish (Pacifastacus leniusculus) of the genus Pacifastacus.

3.  White River Crayfish (Procambarus acutus) of the genus Procambarus.

4. The Regulation is amended by adding the following section:

Transitional exemption — possession, transport of certain species

9.3 (1) Clause 7 (c) of the Act does not apply until January 1, 2026 to a person who possesses or transports a member of a prohibited invasive species listed in subsection (2) if the person possessed the member of the species on the day Ontario Regulation 380/23 came into force.

(2) Subsection (1) applies to the following prohibited invasive species:

1.  Red Shiner.

2.  Species in the genus Pacifastacus.

3.  Species in the genus Procambarus, except for Red Swamp Crayfish (Procambarus clarkii) and Marbled Crayfish (Procambarus virginalis).

5. Table 1 of the Regulation is revoked and the following substituted:
