Amending O. Reg. 783/20

(GENERAL)

1. Section 13 of Ontario Regulation 783/20 is amended by striking out “$19.20” and substituting “$19.90”.

2. Section 15 of the Regulation is revoked and the following substituted:

Criteria

15.  (1) For the purposes of clause 12 (1) (c) of the Act, the prescribed criteria that a francophone organization must meet are the following:

1.  The organization is incorporated under a general or special Act of the Legislature.

2.  The organization promotes knowledge of agriculture and agricultural issues amongst francophones in agricultural and rural areas of Ontario.

3.  The organization provides education or training in respect of agricultural matters, or provides information on obtaining such education or training, to francophones carrying on farming businesses in Ontario.

4.  The organization provides advice and analysis to governments, administrative tribunals or advisory bodies concerning agricultural issues and the development of programs and policies that are of interest to francophones carrying on farming business in Ontario.

5.  The organization is involved in planning, promoting or implementing economic development projects in agricultural and rural areas of Ontario.

6.  The organization maintains a liaison with the accredited farm organizations and other francophone organizations representing farmers.

7.  The organization has at least 40 members who carry on farming businesses in Ontario and who have paid the organization’s membership fee.

8.  The organization has at least 21 members who carry on farming businesses in Ontario that have current farming business registration numbers.

9.  The organization prepares audited financial statements annually in accordance with subsection (2) and makes the statements available to the public within 60 days after its annual general meeting.

10.  The organization makes the audited financial statements prepared in accordance with subsection (2) available to the Tribunal upon the Tribunal’s request.  

(2) The audited financial statements shall include the following:

1.  The total amount of special funding received by the organization in the year.

2.  Financial statements and an auditor’s report prepared by an auditor in accordance with auditing standards.

3.  The number of members in the organization.


 

Commencement

3. This Regulation comes into force on the later of January 1, 2024 and the day this Regulation is filed.
