Amending O. Reg. 201/96

(GENERAL)

1. Subsections 13 (2), (3) and (3.1) of Ontario Regulation 201/96 are revoked and the following substituted:

(2) For the purposes of paragraph 3 of subsection 6 (1) of the Act, the mark-up on the drug benefit price of a listed drug product is,

(a)  8.5 per cent of the drug benefit price, if the total drug cost of the product when supplied is less than $100;

(b)  8 per cent of the drug benefit price, if the total drug cost of the product when supplied is $100 or more but less than $500;

(c)  7 per cent of the drug benefit price, if the total drug cost of the product when supplied is $500 or more but less than $1,000;

(d)  6 per cent of the drug benefit price, if the total drug cost of the product when supplied is $1,000 or more but less than $2,000;

(e)  5.5 per cent of the drug benefit price, if the total drug cost of the product when supplied is $2,000 or more but less than $4,000; and

(f)  5 per cent of the drug benefit price, if the total drug cost of the product when supplied is $4,000 or more.

(3) In subsection (2),

“total drug cost” means the amount that is calculated by multiplying the drug benefit price of the drug product supplied by the quantity of the drug product supplied.

2. Paragraph 3 of subsection 17 (1) of the Regulation is revoked and the following substituted:

3.  A mark-up equal to,

i.  8.5 per cent of the drug benefit price, if the total drug cost of the product supplied is less than $100,

ii.  8 per cent of the drug benefit price, if the total drug cost of the product supplied is $100 or more but less than $500,

iii.  7 per cent of the drug benefit price, if the total drug cost of the product supplied is $500 or more but less than $1,000,

iv.  6 per cent of the drug benefit price, if the total drug cost of the product supplied is $1,000 or more but less than $2,000,

v.  5.5 per cent of the drug benefit price, if the total drug cost of the product supplied is $2,000 or more but less than $4,000, and

vi.  5 per cent of the drug benefit price, if the total drug cost of the product supplied is $4,000 or more.

3. This Regulation comes into force on the later of April 1, 2024 and the day this Regulation is filed.
