Amending O. Reg. 193/23

(REGISTRATION)

1. Section 1 of Ontario Regulation 193/23 is amended by adding the following paragraph:

12.  Certificate of registration in the temporary emergency class.

2. The Regulation is amended by adding the following sections:

Certificate of Registration in the Temporary Emergency Class

Certificate of registration in the temporary emergency class

41.1 The following are non-exemptible registration requirements for a certificate of registration in the temporary emergency class as a psychologist, psychological associate or behaviour analyst:

1.  The Minister must have requested that the College initiate registrations under this class based on the Minister’s opinion that emergency circumstances call for it, or the Council must have determined, after taking into account all of the relevant circumstances that impact the ability of applicants to meet the ordinary registration requirements, that there are emergency circumstances and that it is in the public interest that the College issue emergency certificates.

2.  The applicant must hold,

i.  an instrument equivalent to a certificate of registration that authorizes the applicant to practise the profession in another Canadian jurisdiction,

ii.  an Inactive class of certificate of registration that has been in effect for less than two years, or

iii.  a Retired class of certificate of registration that has been in effect for less than two years.

3.  The applicant must attest that they have familiarized themself with the provisions of Ontario Regulation 195/23 (Professional Misconduct) made under the Act and the College’s professional standards of practice and agree to practise in compliance with them.

Terms, conditions and limitations

41.2 The following are the terms, conditions and limitations of a certificate of registration in the temporary emergency class:

1.  The member must practise the profession only within the scope of their skills, knowledge and judgment.

2.  The member must practise the profession in compliance with Ontario Regulation 195/23 (Professional Misconduct) made under the Act and the College’s professional standards of practice.

3.  The member must maintain professional liability insurance in the amount and in the form required under the by-laws.

4.  The member must promptly and, in any event, within five business days, advise the College in writing if the member ceases to be a Canadian citizen or permanent resident of Canada or to have authorization under the Immigration and Refugee Protection Act (Canada) permitting the member to engage in the practice of the profession in Ontario.

5.  The member may only use, as the case may be,

i.  the title “Temporary Emergency Psychologist”, “Temporary Emergency Psychological Associate” or “Temporary Emergency Behaviour Analyst”,

ii.  the designation “C.Psych. (temporary emergency class)”, “C.Psych.Assoc. (temporary emergency class)” or “R.B.A. (Ont.) (temporary emergency class)”, or

iii.  a variation or equivalent in another language of a title or designation listed in this paragraph.

Expiry and renewal

41.3 (1) A certificate of registration in the temporary emergency class expires on the first anniversary of its issuance or on such earlier date as may be specified on the certificate.

(2) Unless the Council has determined that the emergency circumstances have ended, a certificate of registration in the temporary emergency class may be renewed before its expiry one or more times, for a term of one year or such shorter term as may be specified on the certificate.

(3) Despite subsections (1) and (2), a certificate of registration in the temporary emergency class expires on the day that is six months after the day the Council determines that the emergency circumstances have ended.

Moving to non-emergency class

41.4 (1) A person may apply for and be issued the following certificate of registration, if the person holds a certificate of registration in the temporary emergency class or held a certificate of registration in the temporary emergency class in the six months before making the application:

1.  If the person was authorized under the certificate of registration in the temporary emergency class to practise as a psychologist, a certificate of registration as a psychologist authorizing autonomous practice.

2.  If the person was authorized under the certificate of registration in the temporary emergency class to practise as a psychological associate, a certification of registration as a psychological associate authorizing autonomous practice.

3.  If the person was authorized under the certificate of registration in the temporary emergency class to practise as a behaviour analyst, a certificate of registration for a behaviour analyst authorizing autonomous practice.

(2) A member who is issued a certificate of registration under subsection (1) and who has not previously met the following requirement must do so no later than the first anniversary of the day on which the certificate is issued:

1.  If the member is a holder of a certificate of registration for a psychologist authorizing autonomous practice or a certificate of registration for a psychological associate authorizing autonomous practice, the member must pass the Jurisprudence and Ethics Examination referred to in paragraph 5 of subsection 5 (1).

2.  If the member is a holder of a certificate of registration for a behaviour analyst authorizing autonomous practice, the member must demonstrate successful completion of an assessment of Jurisprudence and Ethics knowledge in accordance with paragraph 4 of subsection 27 (1).

Commencement

3. This Regulation comes into force on the later of the day section 15 of Schedule 4 (Psychology and Applied Behaviour Analysis Act, 2021) to the Advancing Oversight and Planning in Ontario’s Health System Act, 2021 comes into force and the day this Regulation is filed.
