Amending O. Reg. 187/22

(HOME AND COMMUNITY CARE SERVICES)

1. (1) Paragraph 10 of the definition of “homemaking services” in subsection 2 (1) of Ontario Regulation 187/22 is amended by striking out “patient” and substituting “person”.

(2) Paragraph 4 of the definition of “personal support services” in subsection 2 (1) of the Regulation is amended by striking out “patient” and substituting “person”.

2. Subsection 13 (3) of the Regulation is revoked and the following substituted:

(3) Despite subsection (1), the Service Organization shall not provide homemaking services to a patient unless the following eligibility criteria are met:

1. The patient must be an insured person under the Health Insurance Act.

2. At least one of the following must apply:

i. The patient requires personal support services along with the homemaking services.

ii. The patient receives personal support services and homemaking services from a caregiver, and the caregiver requires assistance with the homemaking services in order to continue providing care to the patient.

iii. The patient requires constant supervision as a result of a cognitive impairment or acquired brain injury and the patient’s caregiver requires assistance with the homemaking services.

3. The place in which the services are to be provided must have the physical features necessary to enable the services to be provided.

4. The risk that an individual who provides the services to the patient will suffer serious physical harm while providing the services must not be significant or, if it is significant, the provider of the services must be able to take reasonable steps to reduce the risk so that it is no longer significant.

3. (1) Subsections 33 (2) and (3) of the Regulation are revoked and the following substituted:

(2) Where the Service Organization manages the admission of a patient into an adult day program, the health service provider or Ontario Health Team funded to provide the adult day program is exempt from section 10 of this Regulation in respect of that patient.

(3) Where the Service Organization manages the admission of a patient into a supportive housing program, the health service provider or Ontario Health Team funded to provide the supportive housing program is exempt from section 10 of this Regulation in respect of that patient.

(2) Subsections 33 (6) and (7) of the Regulation are revoked and the following substituted:

(6) Where the Service Organization determines that a patient who requires personal support services should receive those services from a health service provider that is not the Service Organization, the Service Organization may refer the patient to such a health service provider, and the Service Organization is exempt from sections 10, 15, 16, 17, 18 and 22 of this Regulation in respect of that patient.

(7) Where a health service provider that is not the Service Organization determines that a person who requires personal support services should receive those services from the Service Organization, the health service provider may refer the person to the Service Organization, and the provider is exempt from sections 10, 15, 16, 17, 18 and 22 of this Regulation in respect of that patient.

4. Subsections 35 (7) and (10) of the Regulation are revoked.

Commencement

5. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Sections 2 and 3 come into force on the later of the day subsection 1 (1) of the Convenient Care at Home Act, 2023 comes into force and the day this Regulation is filed.
