Amending O. Reg. 246/22

(GENERAL)

1. Section 116 of Ontario Regulation 246/22 is amended by striking out “provided by the Ministry, the Agency or a local health integration network” in the portion before clause (a).

2. The definition of “home and community care services provider” in subsection 240.1 (11) of the Regulation is revoked and the following substituted:

“home and community care services provider” means a health service provider or Ontario Health Team that is funded to provide home and community care services under the Connecting Care Act, 2019; (“fournisseur de services de soins à domicile et en milieu communautaire”)

3. Clause 240.2 (7) (b) of the Regulation is revoked and the following substituted:

(b) that is within a 150 kilometre radius from the patient’s preferred location, if the patient’s preferred location is in the area that was, immediately before the Local Health System Integration Act, 2006 was repealed, the geographic area of the North East Local Health Integration Network or the North West Local Health Integration Network under that Act.

4. The definition of “detailed allocation” in section 248 of the Regulation is revoked and the following substituted:

“detailed allocation” means the reconciliation report for a calendar year, together with the auditor’s report on that reconciliation report, that is submitted to the Minister under clause 288 (1) (a) and to the Agency, as is required by regulations made under the Connecting Care Act, 2019.

5. Subclause 312 (a) (iii) of the Regulation is amended by striking out “the Local Health System Integration Act, 2006”.

6. (1) Paragraph 4 of subsection 353 (3) of the Regulation is amended by striking out “local health integration network”.

(2) Paragraph 7 of subsection 353 (3) of the Regulation is revoked.

7. The Regulation is amended by adding the following section:

Reporting, inspections

388. Paragraph 5 of subsection 28 (1) of the Act and paragraph 6 of subsection 29 (1) of the Act continue to apply, despite the repeal of the Local Health System Integration Act, 2006, as they read immediately before the day that Act was repealed.

Commencement

8. This Regulation comes into force on the later of the day subsection 1 (1) of the Convenient Care at Home Act, 2023 comes into force and the day this Regulation is filed.
