DESIGNATION – CHATHAM-KENT WASTE DISPOSAL SITE

Definition

1. In this Regulation,

“environmental compliance approval” has the same meaning as in the Environmental Protection Act.

Designation

2. The following activities are designated as a project to which Part II.3 of the Act applies:

1.  Resumption of landfill operations at the waste disposal site described in section 3, construction of a new landfill cell at the waste disposal site and other related changes to the waste disposal site.

2.  Expanding the authorized waste handling, processing and transfer operations at the waste disposal site described in section 3 beyond the operations authorized by the environmental compliance approval referred to in paragraph 2 of section 3, including,

i.  increasing the amount of waste that may be accepted at the waste disposal site beyond 75 tonnes per day,

ii.  increasing the amount of waste that may be stored at the waste disposal site at any one time beyond 75 tonnes,

iii.  expanding the types of waste authorized to be received for handling, processing and transfer at the waste disposal site beyond non-hazardous solid waste from the industrial, commercial, institutional and municipal sectors,

iv.  construction of structures at the waste disposal site,

v.  installation of waste processing equipment at the waste disposal site,

vi.  expansion of the area at the waste disposal site used for waste handling, processing and transfer operations beyond 0.8 hectares, and

vii.  other related changes to the waste disposal site.

Waste disposal site

3. The waste disposal site referred to in section 2 is the waste disposal site located at 29831 Irish School Road in the Municipality of Chatham Kent in respect of which the following environmental compliance approvals were issued:

1.  Environmental compliance approval number A021304, issued to Dresden Tile Yard Limited on November 20, 1980, for the use and operation of a 8 hectare landfilling area within a total site area of 35 hectares.

2.  Environmental compliance approval number A020401, issued to Wood Waste Disposal Ltd. on August 17, 1992 and amended on October 13, 1998, for the use of the site for the storage, transfer and processing of non-hazardous solid waste from the industrial, commercial, institutional and municipal sectors.

Commencement

4. This Regulation comes into force on the day it is filed.
