Amending O. Reg. 200/96

(MINOR VARIANCE APPLICATIONS)

1. (1) Subsection 3 (1) of Ontario Regulation 200/96 is amended by striking out “subsection (2) or (4)” and substituting “subsection (2), (4) or (4.1)”.

(2) Section 3 of the Regulation is amended by adding the following subsection:

(4.1) If, in the secretary-treasurer’s opinion, a newspaper described in subsection (4) does not exist, notice may be given by posting a notice on the website of the municipality.

(3) Subsection 3 (9) of the Regulation is amended by adding the following paragraphs:

8. A hospital, as defined in section 1 of the Public Hospitals Act, if the hospital is within one kilometre of the subject land.

9. If a zoning regulation has been made under section 5.4 of the Aeronautics Act (Canada) with respect to lands adjacent to or in the vicinity of an airport, as defined in subsection 3 (1) of that Act, and if any part of those lands is within the subject land, the owner of the airport and, if the owner is not also the operator of the airport, the operator of the airport.

2. Section 3.2 of the Regulation is amended by adding the following subsection:

(2) For greater certainty, despite the amendments made to subsection 3 (9) of this Regulation by Ontario Regulation 289/24 made under the Act, subsection 3 (9) of this Regulation, as it read immediately before those amendments came into force, continues to apply in respect of a notice given under subsection 45 (5) of the Act, if it was given to the persons and public bodies listed under subsection 3 (9) of this Regulation before the day Ontario Regulation 289/24 came into force.

Commencement

3. This Regulation comes into force on the later of July 1, 2024 and the day this Regulation is filed.
