ZONING ORDER — MUNICIPALITY OF CLARINGTON, REGIONAL MUNICIPALITY OF DURHAM

Definition

1. In this Order,

“Zoning By-law” means Zoning By-law 84-63 of the Municipality of Clarington.

Application

2. This Order applies to lands in the Municipality of Clarington, in the Regional Municipality of Durham, in the Province of Ontario, being the lands outlined in red on a map numbered 362 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Permitted uses

3. In addition to the uses permitted by the Zoning By-law on the lands described in section 2, the following uses are permitted:

1. Link townhouse dwellings.

2. Stacked townhouse dwellings.

3. Street townhouse dwellings.

4. Apartment buildings.

5. Ancillary uses, which include,

i. office spaces,

ii. medical care facilities, and

iii. the uses permitted within section 3.11 a of the Zoning By-Law.

Zoning requirements

4. Despite any zoning requirements in the Zoning By-law, the zoning requirements for the lands described in section 2 are as follows:

1. The minimum density is 60 units per hectare.

2. The maximum density is 100 units per hectare.

3. The minimum setback to a public road is 6 metres.

4. The minimum setback to the Urban Residential Type One (R1) Zone is 5 metres.

5. The maximum lot coverage is 50 per cent.

6. The minimum combined resident and visitor parking spaces is 0.7 per dwelling unit.

7. The minimum softscape landscaped open space is 12 per cent.

8. The minimum height of an apartment building is two storeys.

9. The maximum height of an apartment building is six storeys.

10. The maximum height of all other permitted uses is 15 metres.

11. No minimum dwelling unit area is required.

12. The zoning requirements set out in section 3.11 c of the Zoning By-Law apply to the uses permitted by paragraph 3 of section 3 of this Regulation.

Terms of use

5. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

6. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the Municipality of Clarington.

Commencement

7. This Regulation comes into force on the day it is filed.
