On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to subsection 4.3 (16) of the Ontario Energy Board Act, 1998, as re-enacted by Schedule 2 of the Fixing the Hydro Mess Act, 2019, the commissioners and the chief commissioner of the Ontario Energy Board (“OEB”) shall, for the term of their respective appointments by the Lieutenant Governor in Council under that subsection, be entitled to remuneration as follows:

Commissioners’ remuneration:

  1. Each commissioner of the OEB, who is not the chief commissioner, and who serves in this position on a full-time basis, shall be paid remuneration of $164,910 per year.
  2. Each commissioner of the OEB, who is not the chief commissioner, and who serves in this position on a part-time basis, shall be paid remuneration of $788 per day, provided that the total remuneration shall not exceed $164,910 per year.
  3. Each full-time commissioner shall also be eligible to participate in the OEB’s Benefit Program and Pension Tax Equalization Payment program, as established by the OEB and as may be applicable to the full-time commissioner.

Chief Commissioner’s remuneration:

  1. The chief commissioner of the OEB shall serve in this position on a full-time basis and shall be paid remuneration of $207,000 per year.
  2. The chief commissioner shall be eligible to be paid in each year, pay for performance in an amount not to exceed 10 percent of his or her annual remuneration for the year, in accordance with measures established by the board of directors of the OEB consistent with independent adjudicative decision-making.
  3. The chief commissioner’s total annual remuneration, including pay for performance, shall not exceed a maximum of $227,700 in any given year.
  4. The chief commissioner shall also be eligible to participate in the OEB’s Benefit Program and Pension Tax Equalization Payment program, as established by the OEB and as may be applicable to the chief commissioner.

Expenses:

  1. In addition to the remuneration set out above, the commissioners and the chief commissioner shall be reimbursed for reasonable expenses incurred in carrying out their respective duties in accordance with the Management Board of Cabinet’s Travel, Meal and Hospitality Expenses Directive.

Further, this Order in Council shall be effective on the day that subsection 4.3(16) of the Ontario Energy Board Act, 1998, as re-enacted by Schedule 2 of the Fixing the Hydro Mess Act, 2019, comes into force.
