On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas subsection 3.2(1) of the Environmental Assessment Act, R.S.O. 1990, c. E.18 (the “Act”) provides that where the Minister of the Environment, Conservation and Parks considers that it is in the public interest, having regard to the purpose of the Act and weighing it against the injury, damage or interference that might be caused to any person or property by the application of the Act to any undertaking or class of undertakings, the Minister, with the approval of the Lieutenant Governor in Council, may by order declare that the Act or the Regulations or a matter provided for under the Act does not apply with respect to a proponent, a class of proponents, an undertaking or a class of undertakings subject to such conditions as the Minister may impose;

Whereas the Minister of the Environment, Conservation and Parks has been requested to issue a declaration order pursuant to subsection 3.2(1) of the Act for the undertaking described in the attached order (the “Undertaking”);

And whereas, having regard to the purpose of the Act and weighing the same against the injury, damage or interference that might be caused to the persons and property indicated in the attached order by the application of the Act to the Undertaking, the undersigned, Minister of the Environment, Conservation and Parks, considers that it is in the public interest to make an order declaring that the Act and its regulations do not apply to the Undertaking, subject to the terms and conditions imposed in the attached order;

Therefore, pursuant to subsection 3.2(1) of the Act, the attached order declaring that the Act does not apply to the Undertaking, subject to the terms and conditions therein, is approved.
