On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas John L. O'Kane was appointed a deputy mining and lands commissioner in the office of the Mining and Lands Commissioner on July 18, 2016, for a term of three years, by Order in Council O.C. 1149/2016;

And whereas subsection 6(1) of the Ministry of Natural Resources Act (the “Act”), as amended by section 3, Schedule 17 of the Stronger, Healthier Ontario Act (Budget Measures), 2017, continues the office of the Mining and Lands Commissioner as the Mining and Lands Tribunal;

And whereas, pursuant to subsection 1(1) of Ontario Regulation 12/18, for the purposes of constituting the Mining and Lands Tribunal under section 6 of the Act, the Lieutenant Governor in Council shall appoint each deputy mining and lands commissioner who remains in office on March 31, 2018, as a first member of the Tribunal as of April 1, 2018;

And whereas, pursuant to subsection 1(2) of Ontario Regulation 12/18, the appointment of a deputy mining and lands commissioner shall specify that his or her term of office terminates on either of the following dates: the day his or her appointment as a deputy mining and lands commissioner would have expired and July 17, 2019;

Therefore, pursuant to subsection 6(2) of the Act, as amended by section 3, Schedule 17 of the Stronger, Healthier Ontario Act (Budget Measures), 2017, and section 1 of Ontario Regulation 12/18 made under the Act, John L. O'Kane of Brampton be appointed a part-time member of the Mining and Lands Tribunal for a term effective April 1, 2018, and ending July 17, 2019.

Further, pursuant to clause 77(a) of the Legislation Act, 2006, Order in Council O.C. 1149/2016 be revoked effective April 1, 2018.
