On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Transit-Oriented Communities ("TOC") program proposes that transit station infrastructure will be connected to the structure of a broader development for the Ontario Line located in the City of Toronto, the subway extension known as the Scarborough Subway Extension, and also known as the Line 2 East Extension, located in the City of Toronto, the subway extension known as the Yonge Subway Extension, and also known as the Yonge North Subway Extension, extending from within the City of Toronto to within the Regional Municipality of York, and the light rail transit extension known as the Eglinton Crosstown West Extension extending westward from within the City of Toronto at the station known as Mount Dennis;

And whereas pursuant to Order in Council 1198/2022 the Minister of Infrastructure is responsible for functions, responsibilities and programs in respect of TOC, under the Ministry of Infrastructure Act, 2011 ("MOIA");

And whereas Ontario Infrastructure and Lands Corporation ("OILC") has been delegated the Minister of Infrastructure’s authorities to deal with corporations for the purposes of investing assets in, supporting or developing TOC projects, subject to certain conditions, by Delegation of Authority to OILC under the MOIA, dated December 21, 2020;

And whereas pursuant to subsection 7.1(1) of the MOIA, the Minister of Infrastructure, or OILC as a delegate of the Minister, requires approval of the Lieutenant Governor in Council to deal with corporations for the purpose of supporting or developing TOC projects;

And whereas the Minister of Infrastructure wishes to enter into an agreement with CP REIT Ontario Properties Limited and Choice Properties Limited Partnership (the "Companies") for the purpose of developing the Gerrard-Carlaw North TOC project (the "Project");

Now therefore, pursuant to subsection 7.1(1) of the MOIA, the Minister of Infrastructure and OILC are authorized to enter into an agreement with the Companies for the purpose of developing the Project.
