On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ottawa Hospital/L’Hôpital d’Ottawa (“Hospital”) holds title to certain lands and premises known as 1967 Riverside Drive within the City of Ottawa (“City”) that are subject to restrictive covenants for the benefit of the City;

And whereas the City and the Hospital entered into an agreement dated February 22, 2024 (“Ottawa Hospital Riverside Agreement”) which provides for, inter alia, the release of such restrictive covenants on the portion of the Hospital’s lands that are the subject of the proposed development of a long-term care home;

And whereas in consideration of the release of such restrictive covenants by the City, the Ottawa Hospital Riverside Agreement provides for the payment by the Hospital to the City of $12,900,000 (“Consideration”);

And whereas the agreement entered into between the Province of Ontario and the City dated March 22, 2024 (“Ontario-Ottawa Agreement”) provides that, inter alia, the City agrees to assign to the Province of Ontario its rights to receive and retain the Consideration;

And whereas in accordance with the Ontario-Ottawa Agreement, an agreement between the Province of Ontario, the City and the Hospital is in development that would, if executed, assign to the Province of Ontario the City’s rights to receive and retain the Consideration (“Assignment Agreement”);

And whereas the President of the Treasury Board recommends, and the Lieutenant Governor in Council concurs, that, subject to the execution of an Assignment Agreement between the Province of Ontario, the City and the Hospital, it is in the public interest to remit the Hospital’s obligation to pay to the Province of Ontario the Consideration;

Therefore:

  1. Pursuant to section 5.1 of the Financial Administration Act and subject to paragraph 2 of this Order, the remission of the Hospital’s obligation to pay to the Province of Ontario the Consideration in the amount of $12,900,000 is hereby granted.
  2. The remission under paragraph 1 of this Order is conditional upon an Assignment Agreement between the Province of Ontario, the City and the Hospital being executed and, if an Assignment Agreement is executed, shall be effective as of the moment such Assignment Agreement comes into effect.
