These particulars are posted following the expiry of the 15-day period for AAA Great Toronto Truck Driving School Inc., operating as AAA Great Toronto Truck Driving School to require a hearing of the Licence Appeal Tribunal under s. 19(3) of thePrivate Career Colleges Act, 2005 (“the Act”). On March 7, 2022, the Superintendent issued a Notice of Proposal to Refuse to Renew Registration to AAA Great Toronto Truck Driving School. AAA Great Toronto Truck Driving School did not file a notice to the Licence Appeal Tribunal within the 15-day period. The proposal to refuse to renew AAA Great Toronto Truck Driving School’s registration was therefore carried out on April 12, 2022, pursuant to s. 19(4) of the Act.

Reasons for decision

The Superintendent has refused to renew AAA Great Toronto Truck Driving School registration for the following reasons:

  1. Private Career Colleges Act, 2005, s. 18 (2) (b), Breach of Condition of Registration
    • AAA Great Toronto Truck Driving School failed to provide enrolment reports as required by a condition placed on its registration, thereby breaching a condition of AAA Great Toronto Truck Driving School’s registration.
  2. Private Career Colleges Act, 2005, s. 18 (2) (b), Breach of Condition of Registration – Admission Requirements
    • AAA Great Toronto Truck Driving School failed to ensure that every student enrolled in a vocational program met the admission requirements of that program, thereby beaching a condition of AAA Great Toronto Truck Driving School’s registration pursuant to s. 19 (1) of O. Reg. 415/06.
  3. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Contracts to be in writing
    • AAA Great Toronto Truck Driving School provided a vocational program to a student for a fee without entering into a written contract between the student and AAA Great Toronto Truck Driving School, thereby contravening s. 28 (1) of the Act.
  4. Private Career Colleges Act, 2005, s. 18 (2)  (c), Fail to comply with provision of the Act or Regulations – Contract terms
    • AAA Great Toronto Truck Driving School failed to include each term prescribed by s. 20 (1) of O. Reg. 415/06 into every contract entered into between AAA Great Toronto Truck Driving School and a student for the provision of a vocational program, thereby contravening s. 20 (1) of O. Reg. 415/06.
  5. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Non-vocational contracts
    • AAA Great Toronto Truck Driving School used both vocational and non-vocational contracts containing conflicting terms in tandem, or alternatively a non-vocational contract on its own, to enrol students into a vocational program, thereby contravening s. 20 (1) of O. Reg.  4154/06 and s. 21 of O. Reg. 415/06.
  6. Private Career Colleges Act, 2005, s. 18 (2)  (c), Fail to comply with provision of the Act or Regulations – Student files Content
    • Student files provided by AAA Great Toronto Truck Driving School failed to include each item prescribed by s. 45 (1) of O. Reg. 415/06, thereby contravening s. 45 (1) of O. Reg. 415/06.
  7. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Retention of Student files
    • AAA Great Toronto Truck Driving School has not maintained and retained records for every student for a period of three years following the day the student left the program thereby contravening s. 45  (2) of O. Reg. 415/06.
  8. Private Career Colleges Act, 2005, s. 18 (2)  (c), Fail to comply with provision of the Act or Regulations – Charging fees
    • AAA Great Toronto Truck Driving School has charged students fees in relation to an approved vocational program that were not include in the itemized list of provided to the Superintendent as required by s  43 (1) of O. Reg. 415/06, thereby contravening s. 44 (1) of O. Reg 415/06.
  9. Private Career Colleges Act, 2005, s. 18 (2) (c), Fail to comply with provision of the Act or Regulations – Misleading Statements
    • AAA Great Toronto Truck Driving School provided students an admission letter for a vocational program containing misleading information with respect to the contents of the program, thereby contravening subsection 18 (1) of O. Reg. 415/06.
  10. Private Career Colleges Act, 2005, s. 18 (2)  (c), Fail to comply with provision of the Act or Regulations – Obstruction
    • During the inquiries of a designate of the Superintendent pursuant to s. 38 of the Private Career Colleges Act, 2005 AAA Great Toronto Truck Driving School omitted information within AAA Great Toronto Truck Driving School’s possession and relevant to the inquiries from the information provided to designates of the Superintendent, thereby providing misleading information to a designate and contravening s. 38 (10) of the Private Career Colleges Act, 2005.
  11. Private Career Colleges Act, 2005, s. 18 (2) (a), Requirement of subsection 14 (1) no longer met – Financial Responsibility
    • The Superintendent of Private Career Colleges is no longer satisfied that AAA Great Toronto Truck Driving School can be expected to be financially responsible in the operation of the private career college.
  12. Private Career Colleges Act, 2005, s. 18 (2)  (a), Requirement of subsection 14 (1) no longer met – Honesty and Integrity
    • The Superintendent of Private Career Colleges is no longer satisfied that the conduct of AAA Great Toronto Truck Driving School, and its director, provide grounds for the belief that AAA Great Toronto Truck Driving School will operate in accordance with the law and with integrity and honesty.

Superintendent’s action

On April 12, 2022, the Superintendent carried out the proposal to refuse to renew the registration of AAA Great Toronto Truck Driving School.
