These particulars are posted following the issuance of an administrative penalty for which a review was requested. Penalties may be reviewed upon request within 15 days of receipt of a Notice of Contravention. The review decision is made considering not only the information originally available at the time the Notice of Contravention was issued, but also any new information not previously available that may have been supplied in support of the request for a review. On review, an administrative penalty may be upheld, rescinded or reduced. A review decision is final.

s.38 (10) of the Act prohibits any person from hindering, obstructing, or interfering with the Superintendent or designate conducting an inquiry or examination, refusing to answer questions on matters relevant to the inquiry or examination or providing the Superintendent or designate with information on matters relevant to the inquiry or examination that the person knows to be false or misleading.

s. 23 (6) of the Act prohibits a career college from making a substantial change to a vocational program that it has been approved to provide without the further approval of the Superintendent.

O. Reg. 415/06, s. 44 (7) prescribes that upon collecting a fee from a student enrolled in a vocational program, a career college shall issue a receipt setting out the name of the college and of the vocational program, an itemized list of all fees paid, the name of the student and the date the receipt was issued.

Reg. 415/06, s. 45 (1) prescribes that a career college shall maintain a physical or electronic file on each of its student which contains personal identifiers, records of academic evaluations, signed contracts, evidence verifying meeting admission requirements, withdrawal or expulsion letters, refund cheques and copies of receipts issued for payment of fees.

O. Reg. 415/06, s. 35 (1) 4, requires every career college ensure that every student transcript includes a description of any credit or advanced standing given to the student or former student by the career college of accepted by the college prior to the commencement by the student or former student of the college’s vocational program.

Review decision
On June 21, 2024, the review requested by Haulage Network Driving Academy Inc. was completed by the reviewer. The Reviewer has reviewed materials provided by Haulage Network Driving Academy Inc., and by the Superintendent of Career Colleges in making their decision, which is outlined in the following table:
Decision following the review
Consistent with the Notice of Contravention issued on May 25, 2023, the Reviewer determined that the balance of evidence supports that Haulage Network Driving Academy Inc.:
- Obstructed the designate conducting an inquiry by withholding information contravening s. 38 (10) of the Act.
- Failed to comply with conditions of registration contravening s. 15 (3) of the Act.
- Made a substantial change to an approved vocational program without the further approval of the Superinendent contravening s. 23 (6) of the Act.
- Failed to issue compliant itemized receipts to students contravening O. Reg. 415/06, s. 44 (7).
- Failed to maintain compliant student files contravening O. Reg. 415/06, s. 45 (1).
- Failed to include a description of advanced standing granted to students in student transcripts contravening O. Reg. 415/06, s. 35 (1) 4.
