Notice of Default in Complying with the Corporations Tax Act

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

Notice Is Hereby Given under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. All enquiries concerning this notice are to be directed to Ministry of Finance, Corporations Tax, 33 King Street West, Oshawa, Ontario L1H 8H6.

Notice Of Proposed Regulation Under The Local Health System Integration Act, 2006 Health Professionals Advisory Committee

Introduction

The Minister of Health and Long-Term Care on behalf of the Government of Ontario invites public comments on a proposed regulation under the Local Health System Integration Act, 2006 (the Act).

The Act requires each local health integration network to establish a health professionals advisory committee consisting of members from regulated health professions. The Lieutenant Governor in Council is authorized under the Act to make regulations concerning the health professionals advisory committee, including requirements for membership on the committee and its functions.

Under the Act, the Minister is required to publish a notice of the proposed regulation in The Ontario Gazette, containing the wording of the proposed regulation and allow at least 60 days for public comment.

Overview of the Legislation

The Local Health System Integration Act, 2006 was passed by the Legislature on March 1, 2006 and received Royal Assent on March 28, 2006. The purpose of the legislation is to establish an integrated health system to improve the health of Ontarians through better access to health services, coordinated health care and effective and efficient management of the health system at the local level by local health integration networks (LHINs).

Section 16(5) of the Act sets out a requirement for each LHIN to establish a health professionals advisory committee. The provision comes under the planning and community engagement section of the Act and allows the LHIN to engage health professions.

Proposed Regulation under the Local Health System Integration Act, 2006

The proposed regulation sets out the basic mandate and composition of the health professionals advisory committee and requires the committee to be made up of certain regulated health professionals from different health sectors. Other aspects such as the committee’s functions, selection of its members, and their term and committee operations would not be set out in regulation. The Ministry and LHINs are collaborating on a standard recruitment and selection process as well as common guidelines for the operation of the committee. A copy of the proposed regulation is attached as Schedule “A.”

Proposed Mandate of the Health Professionals Advisory Committee

The regulation proposes to set out the basic mandate of the health professionals advisory committee. The mandate of the health professionals advisory committee is to provide “advice to the LHIN on how to achieve patient-centred health care within the local health system for the purpose of assisting the LHIN in carrying out its activities”. The LHIN’s objects are set out in the legislation and include a requirement for LHINs to engage the community of persons and entities involved in the local health system.

When the health professional advisory committee provides advice, the regulation would require that it consider population health, innovative approaches to health service delivery, health human resources utilization, health promotion and wellness and other matters that the LHIN considers appropriate to support it in carrying out its objects.

Composition of the Health Professionals Advisory Committee

To be eligible to sit on a health professionals advisory committee, a person must be a member of a College of a health profession as defined under the Regulated Health Professions Act, 1991, a person registered as a drugless practitioner under the Drugless Practitioners Act or a person registered as a member of the Ontario College of Social Workers and Social Service Workers who holds a certificate of registration for social work.

The members would have to live or work in the LHIN’s geographic area, and they would have to be actively practising in their profession.

The health professionals advisory committee would consist of:

  • 4 physicians: one practising family medicine in the community, a specialist providing inpatient care in a hospital; and two other physicians;
  • 3 nurses; one from the hospital sector and two from the community sector one of whom must be from long-term care – one of the three nurses must be a registered practical nurse (Rpn);
  • 1 dietician from the hospital or community sector;
  • 1 physiotherapist or occupational therapist.
  • 1 pharmacist from the hospital sector or community sector; and
  • 1 social worker from community sector or mental health sector.
  • In addition to these 11 persons, the LHIN may appoint three additional persons, none of whom shall be a physician, a nurse, pharmacist, dietician, social worker or a physiotherapist or an occupational therapist.
  • To be eligible for appointment, a person must not hold an elected, appointed, or any other official position with a professional association or labour union.

The health professionals advisory committee is not a board committee of the LHIN and cannot be delegated any function or authority of the LHIN Board or corporation.

Interested parties are invited to make written comments on the proposed regulation on or before Friday, September 29, 2006. Ontario Regulation Made Under The Local Health System Integration Act, 2006 Health Professionals Advisory Committees

Duties

    1. The duty of a health professionals advisory committee established by a local health integration network under subsection 16 (5) of the Act is to provide advice to the network on how to achieve patientcentred health care within the local health system for the purpose of assisting the network in carrying out its activities.
    2. In providing advice under subsection (1), the health professionals advisory committee shall consider the following matters to support the local health integration network in carrying out its activities:
      1. The health status of those demographic segments of the population that the network specifies.
      2. Innovative approaches to health service delivery.
      3. The utilization of human resources for health care.
      4. Health promotion and wellness.
      5. Other matters that the network considers appropriate and specifies to the committee.

Composition

    1. A local health integration network shall appoint a person as a member of a health professionals advisory committee only if,
      1. the person is,
        1. a person registered as a member of a College of a health profession as defined in the Regulated Health Professions Act, 1991,
        2. a person registered as a drugless practitioner under the Drugless Practitioners Act, or
        3. a person registered as a member of the Ontario College of Social Workers and Social Service Workers who holds a certificate of registration for social work;
      2. the person practises or resides in the geographic area of the network; and
      3. the person is actively practising his or her profession.
    2. A local health integration network shall not appoint a person as a member of a health professionals advisory committee if the person is,
      1. a member of the board or the chief executive officer or an officer of a corporation or entity that represents the interests of persons who are part of the health sector and whose main purpose is advocacy for the interest of those persons; or
      2. an official of a trade union.
    3. A health professionals advisory committee shall consist of at least 11 persons, being,
      1. four members of the College of Physicians and Surgeons of Ontario, being,
        1. one who is authorized to practise in the area of family medicine and who practises in the community,
        2. one who is authorized to practise in a specialty of medicine that is not family medicine and who provides care to inpatients in a hospital, and
        3. two additional members;
      2. three members of the College of Nurses of Ontario,
        1. being one from each of the following sectors: hospital, community and long-term care, and
        2. of whom at least one holds a certificate of registration for registered practical nurses;
      3. one member of the College of Dietitians of Ontario who is from the hospital or community sector;
      4. one member of the College of Occupational Therapists of Ontario or the College of Physiotherapists of Ontario;
      5. one member of the Ontario College of Pharmacists who is from the hospital or community sector; and
      6. one member of the Ontario College of Social Workers and Social Service Workers who is from the community or mental health sector.
    4. In addition to the 11 persons described in subsection (3), a health professionals advisory committee may consist of three other persons, none of whom shall be a member of any of the Colleges mentioned in that subsection.

Statutory Notice Under The Remedies For Organized Crime And Other Unlawful Activities Act, 2001.

Notice To Persons Who Have Suffered Pecuniary And Non Pecuniary Damages By Reason Of Unlawful Activity Resulting In Civil Forfeiture Proceedings In The Matter Of Attorney General Of Ontario And 10 Highness Court, Vaughan; 1993 Mercury Vlr Motor Vehicle Vin 4m2dv11w2pdj15109; 1992 Honda Cax Motor Vehicle Vin Jhmcb7651nc819266 (In Rem) And Thai Van Nguyen.

Pursuant to a court order made in the above proceeding, $122,406.91 has been forfeited to the Crown and deposited in a special purpose account. Any person who has suffered pecuniary or non pecuniary losses in relation to which the proceeding was commenced is entitled to make a claim for compensation.

All claims must comply with the provisions of Regulation 233/03 and be on the prescribed form or they will be denied. Regulation 233/03 may be found at
