Notice of Default in Complying with the Corporations Tax Act

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

Notice Is Hereby Given under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. All enquiries concerning this notice are to be directed to Ministry of Finance, Corporations Tax, 33 King Street West, Oshawa, Ontario L1H 8H6.

Superintendent’s Guideline No. 09/10

Introduction

This Guideline is issued pursuant to s. 268.3 (1) of the Insurance Act for the purposes of the Statutory Accident Benefits Schedule – Effective September 1, 2010 (new Sabs) and the Statutory Accident Benefits Schedule – Accidents on or after November 1, 1996 (old Sabs).

Purpose

The purpose of the Optional Indexation Benefit Guideline is to set out the procedures and formulas for indexation as referred to in section 30 of the new Sabs and section 29 of the old Sabs.

General Application

This Guideline applies to named insured persons who have purchased the optional indexation benefit, their spouse, dependants and persons specified as drivers under the policy.

Indexation applies to the following benefits and monetary limits:

  1. the weekly amount of any income replacement benefit
  2. the weekly amount of any non-earner benefit
  3. the weekly monetary limits applicable to income replacement benefits
  4. the weekly monetary limits applicable to caregiver benefits
  5. the monthly attendant care monetary limits
  6. the outstanding balance of medical and rehabilitation benefits available
  7. the outstanding balance of attendant care benefits available
  8. the outstanding balance of medical, rehabilitation and attendant care benefits available to persons who have access to the optional increased medical, rehabilitation and attendant care benefit

Benefit amounts and monetary limits are indexed on January 1 of each year immediately following the accident.

Indexation Percentage

The indexation percentage is the percentage change in the “Consumer Price Index for Canada (All Items)”, as published by Statistics Canada under the authority of the Statistics Act (Canada), for the period from September in the year immediately preceding the previous year to September of the previous year.

Indexation Of Income Replacement Benefit (Irb) And Non-Earner Benefit

The weekly amount of a person's income replacement benefit and the applicable monetary limit are adjusted using the indexation percentage on January 1 of the year immediately after the accident. In each subsequent year, the weekly benefit and limit from the previous year are adjusted. Indexation is applied before taking into account any collateral source income.

Similarly, with respect to the non-earner benefit, the benefit limits are adjusted using the indexation percentage on January 1 of the year immediately after the accident. In each subsequent year, the previous year's amount is adjusted. Indexation is applied before taking into account any collateral source income.

Indexation Of Weekly Limits For Caregiver Benefit And Monthly Limits For Attendant Care Benefit

The indexation percentage is applied to the monetary limits for the caregiver benefit and the attendant care benefit on January 1 of the year immediately following the accident. In each subsequent year, the limits from the previous year are adjusted.

Indexation shall be performed in accordance with the following formula:

A = B x (1 + (C ÷ 100)) where:

A = the new amount (i.e., the new monetary limit or the new weekly benefit)
B = the previous year's amount
C = the indexation percentage

Indexation Of Medical, Rehabilitation And Attendant Care Limits

The outstanding balance with respect to medical and rehabilitation benefits, and the outstanding balance with respect to the attendant care benefit, are indexed on January 1 of each year immediately after the accident. Indexation of these limits is performed using the declining balance method.

Incurred medical, rehabilitation and attendant care expenses up to December 31 of the year are subtracted from the insured person's limits for that year, for each benefit. The indexation percentage is applied to the outstanding balance (i.e., the unused portions). The indexed amounts become the insured person's new monetary limits for the year. Indexation using the declining balance method applies to each of the following:

  1. the combined medical and rehabilitation monetary limit;
  2. the attendant care monetary limit; and
  3. the combined medical, rehabilitation and attendant care monetary limit, if the optional medical, rehabilitation and attendant care benefit was purchased.

Indexation using the declining balance method shall be applied in accordance with the following formula:
A = (B - C) x (1 + (D ÷ 100)) where:

A = the new monetary limit (i.e., new medical and rehabilitation monetary limit, new attendant care monetary limit or new combined monetary limit available to the person)
B = the previous year's monetary limit
C = the sum of all incurred expenses for the previous year (i.e. sum of medical expenses, rehabilitation expenses or attendant care expenses)
D = the indexation percentage

Notice Of Outstanding Balance

Upon the request of the insured person, insurers are to provide a notice stating the outstanding balance (as indexed) of the medical and rehabilitation benefits, the attendant care benefit, and the outstanding balance of the combined benefits, if applicable, as of January 1 of the year.

This requirement does not apply where section 50 (2) of the new Sabs applies to require an insurer to provide periodic benefit statements to the insured person.

      1. Every registered political party which had candidates in 50 per cent or more of Ontario’s provincial electoral districts in the 2007 general election or in any subsequent general election:
        1. Any registered political party which has not met the 50 per cent candidate threshold described above may opt to use an electronic database.
        2. The Chief Electoral Officer must approve the use of any electronic database used by a registered political party for recording contributions and issuing tax receipts.
      2. is required to use an electronic database for all contributions no later than June 1, 2012; and
      3. may use an electronic database for contributions made to the registered political party, its constituency associations, or its candidates as early as June 1, 2011.

Assessment and approval of the registered political party’s electronic database

    1. The electronic database shall be assessed and approved by the Chief Electoral Officer prior to being used. The electronic database shall be approved if it meets the requirements of the Election Finances Act and the requirements outlined in these guidelines.
    2. Any material changes to the electronic database shall require approval by the Chief Electoral Officer prior to being implemented in a production version of the system.
    3. The registered political party shall apply with Elections Ontario to commence the assessment process by providing written notice to the Chief Electoral Officer.
    4. Upon receiving the registered political party’s application for assessment, Elections Ontario will require a period of 20 business days to perform a site visit and apply the “Electronic Database Evaluation” tool to determine if the requirements have been met by the electronic database. The “Electronic Database Evaluation” tool can be obtained by the registered political party upon request to Elections Ontario.
    5. The registered political party shall facilitate the assessment process by providing Elections Ontario with reasonable access to the information required.
    6. If the registered political party’s electronic database meets the requirements as outlined in the” Electronic Database Evaluation” tool, the electronic database shall be approved by Elections Ontario for use by the registered political party.
    7. The electronic database will not be approved until all mandatory elements of the “Electronic Database Evaluation” tool have been met.

Role of the registered political party chief financial officer

    1. the chief financial officer of the registered political party may at his or her discretion delegate the administrative duties which are required under these guidelines to the registered political party staff or volunteers. The delegation shall not limit the chief financial officer’s responsibility.

Recording of contributions by a registered political party

    1. The chief financial officer for the registered political party shall record all contributions received by the registered political party in the party’s electronic database.

Recording of contributions by a registered political party for its constituency associations and candidates

    1. The chief financial officer of a registered political party may accept contributions on behalf of a constituency association or candidate if the registered political party:
      1. is authorized to accept agency contributions and deposit those contributions in a trust account maintained by the registered political party as permitted by Election Finances Act guideline on agency contributions; or
      2. has received from the constituency association or candidate:
        1. written authorization to accept contributions and deposit those contributions directly into their bank accounts; and
        2. the details of the contribution.
    2. The chief financial officer for the registered political party shall record these contributions in the party’s electronic database.

Recording of contributions by constituency associations and candidates

    1. The chief financial officers of constituency associations and candidates are responsible for ensuring all contributions received by the constituency association or candidate are recorded in the party’s electronic database. This may be accomplished by:
      1. having direct access to the party’s electronic database to record the contribution; or
      2. sending the supporting contribution documentation to the registered political party to allow the party to record the contribution into the party’s electronic database.
    2. If the chief financial officer of the constituency association or candidate inputs the contribution information directly into the party’s electronic database, all contribution information and supporting documentation shall be sent regularly to the registered political party or immediately upon the registered political party’s request.

Issuing of tax receipts

    1. The chief financial officer of the registered political party is required to verify all contribution information in the electronic database prior to issuing the tax receipts.
    2. The chief financial officer of the registered political party is required to issue all tax receipts generated from the party’s electronic database, whether in paper or electronic form, for all contributions received by the registered political party, by its constituency associations, and by its candidates.
    3. The chief financial officer of the registered political party is required to issue tax receipts from the electronic database for both monetary and goods and services contributions.
    4. The chief financial officers of constituency associations and candidates shall not issue tax receipts for contributions.

Cancellation of tax receipts

    1. The Chief Electoral Officer may require the chief financial officer of a registered political party to cease issuing tax receipts for contributions. The chief financial officer shall, immediately upon receiving notice to do so, stop issuing tax receipts for contributions.

Contribution reporting to constituency associations and candidates

    1. The registered political party is required to provide contribution reporting to the chief financial officer of each constituency association and candidate in order to allow them to complete the required financial statements and for audit purposes.
    2. Contribution reporting shall be provided to the chief financial officer of each constituency association and candidate:
      1. on a regular basis; or
      2. as requested by the chief financial officer of a constituency association or candidate.
    3. Based on the contribution reporting provided by the registered political party, the chief financial officer of the constituency association and/or candidate is required to ensure all contributions received by the constituency association and/or candidate have been recorded in the registered political party’s electronic database.

Electronic database functionality requirements

    1. The electronic database shall allow relationships to exist between data entities to improve and increase the accuracy and integrity of the data being captured.

Security

    1. The electronic database shall provide controls over system access to protect the accuracy, completeness, and integrity of data. Specifically, it shall allow:
      1. only users with an assigned username and password to access the system;
      2. new database users to be created;
      3. all users to be uniquely identified within the database;
      4. roles to be created (for example chief financial officer, auditor);
      5. roles to be assigned access to various system functions (for example contributions, reports, administration);
      6. roles to be assigned to electronic database users;
      7. a system administrator role to be assigned to one or more users;
      8. user accounts to be designated as inactive – disabling the user’s account access; and
      9. users to change their passwords at their own discretion.

Transaction history (‘audit trail’)

    1. The electronic database shall provide an audit trail allowing the traceability of all items of information from the source of each contribution to the tax receipt. Specifically, the electronic database shall:
      1. uniquely identify all transactions; and
      2. record all transactions that are made within the database including:
        1. creation of a new record;
        2. new value of the record being modified;
        3. old value of the record being modified;
        4. user who modified the record;
        5. date and time that the record was modified; and
        6. description of the task.
    2. For audit trail purposes, records shall not be deleted from the electronic database. Records shall be maintained in the electronic database to meet Canada Revenue Agency requirements.

Accuracy

    1. The electronic database shall be designed to enter, maintain, store and report on records in such a fashion that these records present a complete and accurate representation of the contribution activities for the registered political party, constituency association, and candidate.

Information recorded in the electronic database

    1. Each contributor who makes a contribution shall have his or her information recorded once in the electronic database in a contributor record.
    2. The contributor record shall, in turn, be associated to the contribution information in a contribution record that contains the data for the contribution that was made.
    3. Each contributor record shall:
      1. be uniquely identified in the database;
      2. identify the contributor’s name:
        1. for individuals, the electronic database shall capture the individual’s first and last name (last name first);
        2. for corporations, the electronic database shall capture the corporation’s legal name; or
        3. for trade unions, the electronic database shall capture the trade union’s name and local/district if applicable.
      3. identify the contributor’s mailing address; and
      4. identify the contributor type (individual, corporation, or trade union).
    4. Each contribution record shall:
      1. be uniquely identified in the database;
      2. identify the registered political party, constituency association, or candidate for whom the contribution was made;
      3. identify if the contribution is an agency contribution;
      4. identify the type of contribution being made (monetary or goods and services);
      5. identify the amount of the contribution;
        1. for an agency contribution, identify each of the amounts allocated to the registered political party, constituency association(s), and/or candidate(s).
      6. identify the day, month, and year that the contribution was accepted (deposited); and
      7. identify the contribution period:
        1. annual (specifying year); or
        2. campaign (specifying specific general election or by-election).

Validation and controls within the electronic database

    1. The electronic database shall provide a mechanism for the registered political party, constituency association, or candidate to identify contributions and contributors that are non-compliant with the legislation defined in the Election Finances Act. Specifically, the electronic database shall allow the party to identify:
      1. ineligible contributors as defined in the Election Finances Act along with any associated contribution records;
      2. contributors that are duplicated in the electronic database (e.g.: contributors that have similar names or similar addresses);
      3. contribution records that are duplicated in the electronic database (e.g.: may have the same contributor, on the same date, for the same contribution amount, made to the same registered political party, constituency association, or candidate); and
      4. contributors that may have exceeded the maximum contribution limits as defined in the Election Finances Act.
    2. Flagged contributor and contribution records shall be resolved by an electronic database user.
    3. The action taken by an electronic database user to resolve flagged contributor and contribution records (e.g.: refunded, approved, disapproved) shall be recorded.

Generating tax receipts from the electronic database

    1. The electronic database shall allow generation of electronic tax receipts for all approved contribution records in the electronic database.
    2. The electronic database shall allow tax receipts to be generated from the contribution record information stored in the electronic database.
    3. The electronic database shall record the contribution information that was used to create the tax receipt (tax receipt record) in accordance with Canada Revenue Agency requirements.
    4. Once a tax receipt has been generated, there shall not be any changes to that tax receipt record.
    5. For audit trail purposes, the electronic database shall record the following for each tax receipt generated from the electronic database:
      1. the electronic database user’s identifier in order to determine the user who generated the tax receipt;
      2. the time, day, month, and year that the tax receipt was generated; and
      3. the contribution record(s) that was used to generate the tax receipt.
    6. The registered political party shall use a sequential numbering system to uniquely identify tax receipts issued for the registered political party, constituency associations, and candidates. Based on this sequential numbering system, the electronic database shall uniquely identify each tax receipt record.
    7. The electronic database shall generate tax receipts containing the following information:
      1. a statement that it is an “official receipt for income tax purposes”;
      2. the registered political party’s name, or constituency association’s name, or candidate’s name for whom the contribution was made;
      3. the date of acceptance;
      4. the date when the tax receipt was issued;
      5. amount of the contribution;
      6. name and address of the contributor;
      7. signature of an authorized person;
      8. a unique tax receipt identifier;
      9. indicator that identifies the contributor type (individual , corporation, or trade union);
      10. indicator that identifies the contribution type (monetary or goods and services); and
      11. registered political party name (to appear on all tax receipts generated).
    8. In the case that the contributor has lost a tax receipt, the electronic database shall have the capability to re-print the tax receipt. No information shall be altered from the original tax receipt (including the tax receipt number) and the re-printed tax receipt shall say ‘Copy’. The electronic database shall have the mechanism to identify the tax receipt as ‘lost’ in the system.
    9. In the case that a tax receipt needs to be cancelled, the electronic database shall have the capability to generate a Cancellation Notice and issue a new tax receipt if required. The new tax receipt shall say ‘this cancels and replaces receipt # (insert the tax receipt number of the cancelled tax receipt)”. The electronic database shall have the mechanism to identify the original tax receipt as ‘cancelled’ in the system.
    10. The electronic database may allow generated electronic tax receipts to be emailed to a contributor. If a tax receipt is emailed to a contributor:
      1. the tax receipt shall be in a read-only or non-editable format. The recipient contributor shall only be able to read and print the tax receipt in accordance with Canada Revenue Agency requirements; and
      2. the electronic database shall contain the email address that is being used, which shall be associated to the contributor.

Reporting

    1. The electronic database shall allow reports to be generated from information that is stored in the electronic database.
    2. The electronic database shall provide sufficient security such that only authorized users are able to generate reports.
    3. The electronic database shall have the capability to provide Elections Ontario with the following reports:
      1. a “Tax Receipt Summary” report that:
        1. lists all contributions received by tax receipt number. The report shall include tax receipts issued for the registered political party, its constituency associations, and its candidates; and
        2. shall be generated by the registered political party and submitted to Elections Ontario accompanying the financial statements. This report will be provided in lieu of the copies of the hard copy tax receipts.
      2. a “List of Contributors Whose Contributions Totalled More than $100” report that:
        1. shall be generated by the registered political party and submitted to Elections Ontario accompanying the financial statements. There shall be a separate report which accompanies the financial statements provided by the registered political party, its constituency associations, and its candidates.
    4. The structure of the reports to be provided to Elections Ontario shall comply with ‘Elections Ontario’s Contribution Reporting Technical Specifications’. This can be obtained upon request to Elections Ontario.
