Notice To Creditors, Heirs, And Others

In the estate of Walter Ross Harrison, deceased. All persons having claims as creditors and heirs against the estate of the abovementioned, late of the City of Toronto, in the Province of Ontario, on the 8th day of February, 2011, are required to file proof of the same with the Estate Trustee on or before the 30th day of September, 2012. After that date, the Estate will be distributed with regard only to the claims of which the Estate Trustee shall then have notice; and the Estate Trustee will not be liable to any person of whose claim they shall not then have notice.

Take notice that pursuant to the Funeral, Burial, and Cremation Services Act, S.O. 2002, Chapter 33, the undersigned intends to make application for an order to close part of St. Peter’s Lutheran Cemetery.

The cemetery is owned by Peace Lutheran Church of Tillsonburg, and located at the N.E. corner of Rhineland road and the 1st. Conc. S.T.R. of Middleton Township, Norfolk County, part of lot 36 (177). The area of the cemetery consists of 3.16 acres. The section to be closed consists of 2.29 acres and contains the former church and Pastor’s residence.

The area that is to be retained as the cemetery, consists of .87 acres and contains approximately 600 graves .There are approximately 95 grave sites paid for and reserved for future burials. St. Peter’s Lutheran Cemetery Board will still continue to manage, maintain and preserve the existing cemetery and honor any outstanding interment rights. The existing cemetery will not be affected and is not part of the area proposed for closure. The proposed new boundaries, as set by the survey, are valid. An archaeological assessment of the area proposed for closure was completed by Timmins-Martelle Heritage Consultants Inc. on April 30, 2012. This investigation confirmed that there are no burials or graves in the part of the cemetery proposed for closure.

The reason for the closure is the pending sale of the part of the property to be closed. The sale has a closing date of Oct. 1, 2012, and one of the conditions is the completion of the severance of the existing cemetery.

Take further notice that, interested persons may make submissions regarding the proposed application in writing to:
