ontario securities commission amendments to national instrument 24-101 institutional trade matching and settlement

On July 1, 2020, amendments to National Instrument 24-101 Institutional Trade Matching and Settlement (NI 24-101) will come into force under the Securities Act.

NI 24-101 was amended to provide a three-year moratorium on the applicability of section 4.1 of NI 24-101. Specifically, registered dealers and advisers will not be required to deliver Form 24-101F1 to the Ontario Securities Commission beginning on July 1, 2020 and ending on July 1, 2023.

Notice of Proposed Regulation

Personal Health Information Protection Act, 2004

The Minister of Health on behalf of the Government of Ontario invites public comments on regulations proposed to be made under the Personal Health Information Protection Act, 2004 (“PHIPA”).

PHIPA came into force on November 1, 2004. Ontario Regulation 329/04, “General,” made under PHIPA (“the PHIPA Regulation”) also came into force on November 1, 2004. The Government is proposing amendments to the PHIPA Regulation. The Minister has exercised her authority under paragraph74(4)(a) to shorten the 60 days normally required under PHIPA for public comment to 14 days. After this posting timeline, the Minister reports to the Lieutenant Governor in Council, who may then finalize the regulation with or without changes.

Content of Proposed Regulation

The proposed regulation would allow the Institute for Clinical Evaluative Sciences (ICES) and Ontario Health, at the request of the Minister, to disclose personal health information to the Ministry of Health (MOH) for the purpose of researching, analyzing, investigating, preventing, responding to or alleviating COVID-19 or its effects. The personal health information would be used by the MOH as permitted under existing PHIPA authorities. The proposed regulation would be in force for a total of 24 months.

Invitation to Provide Comments on Proposed Regulation

The public is invited to provide written comments on the proposed regulation over a 14-day period, commencing on June 20, 2020 and ending on July 4, 2020.

As permitted under PHIPA subsection 74(4), the Minister of Health is authorized to shorten the 60-day consultation period if, in the Minister’s opinion, the urgency of the situation requires it.

In providing comments, please consider whether the proposed amendments to the PHIPA Regulation should be made, with or without changes. Furthermore, please consider whether any other amendments should be made to the proposed PHIPA Regulation. Please be as specific as possible and provide a full rationale for any suggested changes or additions.

1. 1. Section 18 of Ontario Regulation 329/04 is amended by adding the following subsections:
      11. Despite subsection 45 (6) of the Act, the Institute for Clinical Evaluative Sciences and Ontario Health may, upon request of the Minister, disclose personal health information to the Minister where the Minister has determined that such disclosure is necessary for the purposes of researching, analyzing, investigating, preventing, responding to or alleviating COVID-19 or its effects.
      12. In disclosing personal health information under subsection (11), the Institute for Clinical Evaluative Sciences and Ontario Health shall comply with any requirements specified by the Minister.)
   2. Subsections 18 (11) and (12) of the Regulation, as made by subsection (1), are revoked.
