Notice of Amendments to the Distribution System Code

Amendments made on February 16, 2024 come into force on May 27, 2024:

  1. Section 1.2 is amended by adding the following definitions:

    “Electric Vehicle Supply Equipment” or “EVSE” means electrical supply equipment that is dedicated to supplying a source of electricity for the sole purpose of charging electric vehicles;

    “Electric Vehicle Charging Connection Procedures” means the document issued from time to time by the Board that sets out a procedure for the connection of EVSE and that is referred to in sections 6.1.6 and 6.1.6.1;

  2. Section 1.7 is amended by inserting the following sentence at the end of the section:

    “The amendments to section 1.2 and 6.1 made by the Board on February 16, 2024 come into force on May 27, 2024.”

  3. Section 6.1 is amended by inserting the following sections immediately after section 6.1.5:

    “Electric Vehicle Supply Equipment Connections for Non-residential Customers

    6.1.6 A distributor shall follow the connection and expansion requirements of this Code as well as the requirements of the Electric Vehicle Charging Connection Procedures to process a request for connection of non-residential EVSE where the connection requires modifications or additions to the distributor’s distribution system.

    6.1.6.1 A distributor shall include in its Conditions of Service an appendix setting out any additional requirements related to the connection of EVSE that are not specified in this Code or the Electric Vehicle Charging Connection Procedures. The appendix shall be in the form of Appendix 1 to the Electric Vehicle Charging Connection Procedures which sets out the minimum information a distributor shall include in the Conditions of Service appendix.”

Notice of Proposed Regulation

Personal Health Information Protection Act, 2004

The Minister of Health on behalf of the Government of Ontario invites public comments on an amending regulation proposed to be made under the Personal Health Information Protection Act, 2004 (“PHIPA”).

PHIPA came into force on November 1, 2004. Ontario Regulation 329/04 (General) made under PHIPA (“the PHIPA General Regulation”) also came into force on November 1, 2004. The Government is proposing amendments to the PHIPA General Regulation. PHIPA requires that the Minister publish a notice of the proposed regulation and allow 60 days for public comment, after which the Minister reports to the Lieutenant Governor in Council, who may then finalize the regulation with or without changes.

Content of Proposed Amending Regulation

The proposed regulation would make the following amendments to the PHIPA General Regulation to support data completeness and quality in the provincial Electronic Health Record (EHR). In addition to the existing requirement for operators of public hospitals, the proposed amendments would, if approved, require operators of accredited community pharmacies and integrated community health services centres to contribute certain personal health information to the EHR as requested by OH and in accordance with OH’s interoperability specifications.

The public is invited to provide written comments on the proposed regulation over a 60-day period, commencing on May 25, 2024 and ending on July 24, 2024.

In providing comments, please consider whether the proposed regulation should be made, with or without changes. Furthermore, please consider whether any other regulatory amendments should be made to the PHIPA General Regulation. Please be as specific as possible and provide a full rationale for any suggested changes or additions.

1. Subsection 18.1.3 (1) of Ontario Regulation 329/04 is revoked and the following substituted:

Information from health information custodians

(1) The classes of health information custodians or specific health information custodians listed in subsection (1.1) shall provide to the Agency for the electronic health record personal health information contained in a digital health asset,

  1. as requested by the Agency; and
  2. in accordance with the interoperability specifications of the Agency.

(1.1) The classes of health information custodians or specific health information custodians referred to in subsection (1) are every person who operates one of the following:

  1. A hospital within the meaning of the Public Hospitals Act.
  2. A pharmacy for which a certificate of accreditation of the community pharmacy class has been issued under the Drug and Pharmacies Regulation Act.
  3. An integrated community health services centre within the meaning of the Integrated Community Health Services Centres Act, 2023.
