Bulletin information:

Issue Date: April 16, 2009
Legislation: Land Titles Act

Bulletin content:

Applications for First Registration under the Land Titles Act and Applications for Absolute Title (LTCQ to LT+) require a draft plan of survey to be circulated with the Notice of Application to all interested parties. Both processes require the subject lands to be described in relation to a draft reference plan attached to the Notice.

To ensure consistency and minimize any potential misunderstandings regarding the extent of the lands under application, the description of the subject lands in the Notice and Application documents must reference the name of the Ontario Land Surveyor who prepared the draft plan and the date of the surveyor’s signature.

Notice of Application description example:

Part of Lot 1, Concession 6, Township of Patagonia, County of Argentina, and shown as Parts 1 and 2, on the attached draft reference plan (or in the Application ‘ the draft reference plan attached to the Notice of Application’) signed by J. Doe O.L.S. and dated January 1, 2009. Subject to an easement over Part 2, in favour of Part of Lot 2, Concession 6, being PIN 12345-1234, as in RO654321.

Should you have any questions, please contact your Regional Surveyor.
