Section 92 of the Registry Act provides that the Director of Land registration may designate an area of land as a subdivision plan area by registering a restraining order. Once the restraining order is registered, the land cannot be dealt with contrary to the order unless there is compliance with the subdivision control provisions of the Planning Act, or the Director’s written consent is endorsed on the instrument. The Director may alter or withdraw the restraining order, with or without imposing certain conditions.

Amendments to the Registry Act made in 1980 provided for the repeal of section 92 on a day to be named by proclamation. The date of the repeal of the section has not yet been proclaimed.

Accordingly, after consultation with the Ministry of Municipal Affairs and Housing, on July 30, 1997, section 92 of the Registry Act will be repealed. As of that date, all restraining orders and directions designating areas of land as subdivision plan areas made under this section, or a predecessor thereof, are rescinded.
