New legislation was introduced by the Ministry of Community and Social Services in 1998 to permit the registration of liens in certain situations against real property owned by participants of Ontario Works and the Ontario Disability Support Program (ODSP). The lien is a mechanism for the Province to recover costs when a property is sold.

Liens under these two Acts may be registered by either the Ministry of Community and Social Services (MCCS) or by a Delivery Agent. Attached are examples of a completed lien by both the Ministry and Delivery Agency as well as samples of discharged liens.

If a lien under either the Ontario Disability Support Program Act, 1997 or the Ontario Work Act, 1997 is presented for registration in the form consistent with the examples and is properly executed, it should be accepted for registration.

Depending upon the system in which the property is registered, the lien should be abstracted as set out in section 7 of the Registry System Abstracting Standards, section 9 of the Land Titles Abstracting Standards and section 5 of the POLARIS Automated Abstracting Guide.
