PILOT PROJECT — LOW-SPEED VEHICLES

Definitions
1. In this Regulation,
“conservation authority” has the same meaning as “authority” in the Conservation Authorities Act;
“conservation authority land” and “conservation land” have the same meanings as in the Conservation Land Act;
“conservation officer” means a conservation officer under the Fish and Wildlife Conservation Act, 1997;
“low-speed vehicle” means a motor vehicle that,
(a) meets the definition of low-speed vehicle in subsection 2 (1) of the Motor Vehicle Safety Regulations made under the Motor Vehicle Safety Act (Canada),
(b) meets the requirements for low-speed vehicles set out in Schedule III to the Motor Vehicle Safety Regulations made under the Motor Vehicle Safety Act (Canada), and
(c) bears a label affixed by the manufacturer in compliance with the requirements for low-speed vehicles in section 6 of the Motor Vehicle Safety Regulations made under the Motor Vehicle Safety Act (Canada);
“park warden” and “provincial park” have the same meanings as in the Provincial Parks Act;
Note: On the day section 65 of the Provincial Parks and Conservation Reserves Act, 2006 comes into force, the definitions of “park warden” and “provincial park” are revoked and the following substituted:
“provincial park” has the same meaning as in the Provincial Parks and Conservation Reserves Act, 2006;

“public park” means land designated by a municipality by by-law for use as a park. O. Reg. 449/06, s. 1.
Pilot project re low-speed vehicles
2. A pilot project to evaluate the use of low-speed vehicles on highways is established. O. Reg. 449/06, s. 2.
Prohibition
3. Under this project, no person shall drive a low-speed vehicle on a highway except as permitted by this Regulation. O. Reg. 449/06, s. 3.
Permitted use
4. (1) A park warden, conservation officer or other employee of the Ministry of Natural Resources who holds a valid driver’s licence, other than a Class M1, M2, M or G1 driver’s licence, may drive a low-speed vehicle on a highway or portion of a highway in a provincial park where the posted speed limit is 40 kilometres per hour or less. Note: On the day section 65 of the Provincial Parks and Conservation Reserves Act, 2006 comes into force, subsection (1) is revoked and the following substituted:
(1) An officer within the meaning of the Provincial Parks and Conservation Reserves Act, 2006, a park warden or other employee of the Ministry of Natural Resources who holds a valid driver’s licence, other than a Class M1, M2, M or G1 driver’s licence, may drive a low-speed vehicle on a highway or portion of a highway in a provincial park where the posted speed limit is 40 kilometres per hour or less. (2) An employee of a conservation authority or a conservation officer who holds a valid driver’s licence, other than a Class M1, M2, M or G1 driver’s licence, may drive a low-speed vehicle on a highway or portion of a highway on conservation authority land or conservation land where the posted speed limit is 40 kilometres per hour or less. (3) An employee of a municipality who holds a valid driver’s licence, other than a Class M1, M2, M or G1 driver’s licence, may drive a low-speed vehicle on a highway or portion of a highway in a public park of the municipality for which the employee works where the posted speed limit is 40 kilometres per hour or less. (4) Every person who is permitted to drive a low-speed vehicle under this section shall carry his or her driver’s licence and proof of employment at all times while in charge of a low-speed vehicle and shall produce the driver’s licence and proof of employment for reasonable inspection upon demand of a police officer or officer appointed for carrying out the provisions of the Act. Application of Act
5. (1) Subject to subsection (2), the Act applies to the operation of a low-speed vehicle in accordance with this Regulation and to a person who is in charge of or drives a low-speed vehicle in accordance with this Regulation. O. Reg. 449/06, s. 5 (1).
(2) Parts II, III, VI, other than sections 73 and 74, subsection 75 (5) and section 106, and X.3 of the Act do not apply to the operation of a low-speed vehicle or to a person who is in charge of or drives a low-speed vehicle in accordance with this Regulation. O. Reg. 449/06, s. 5 (2).
Reports
6. A municipality, conservation authority or the Ministry of Natural Resources shall, if requested by the Minister, report to the Minister on the use of low-speed vehicles under this Regulation, or on any aspect of such use as may be specified by the Minister. O. Reg. 449/06, s. 6.
