Amending Reg. 977 of R.R.O. 1990

Note: Since the end of 2001, Regulation 977 has been amended by Ontario Regulations 40/02, 41/02 and 136/02.  Previous amendments are listed in the Table of Regulations published in The Ontario Gazette dated January 19, 2002.

1. (1) Subsection 10.11 (1.1) of Regulation 977 of the Revised Regulations of Ontario, 1990 is amended by striking out “and” at the end of clause (a), by adding “and” at the end of clause (b) and by adding the following clause:

(c) on or after January 1, 2002, in the case of employees described in paragraph 2 of subsection (3) who are represented by the Commissioned Officers’ Association.

(2) Clause 10.11 (4) (a) of the Regulation is amended by striking out “the Commissioned Officers’ Association”.

2. Clause 10.14.1 (5) (a) of the Regulation is amended by striking out “the Commissioned Officers’ Association”.

3. (1) Section 14 of the Regulation is amended by adding the following subsection:

(1.1) For the purposes of subsection 22 (4) of the Act and this section, a full-time civil servant is not released from employment until he or she is given the written notice required by this section.

(2) Subsection 14 (2) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(2) If a full-time civil servant receives the written notice of release required by this section and if, in any ministry to which the civil servant applies, there is a vacant position,

. . . . .

(3) Paragraph 1 of subsection 14 (3) of the Regulation is amended by striking out “the notice of his or her release” and substituting “the written notice of release required by this section”.
