Amending Reg. 27 of R.R.O. 1990

(General)

1. Subsection 28 (5) of Regulation 27 of the Revised Regulations of Ontario, 1990 is amended by striking out “the title “architect”” and substituting “the title “architect (retired)””.

2. Subsection 29 (3) of the Regulation is amended by striking out “the title “architect”” and substituting “the title “architect (retired)””.

3. Subsection 30 (3) of the Regulation is amended by striking out “the title “architect”” and substituting “the title “architect (retired)””.

4. Section 35 of the Regulation is revoked and the following substituted:

35. Every certificate of practice is subject to the term and condition that the holder of the certificate of practice must comply with the Act and the regulations.

5. Section 40 of the Regulation is revoked.

6. (1) Paragraph 2 of the definition of “professional misconduct” in section 42 of the Regulation is revoked and the following substituted:

2. Knowingly contravening any provision of the Building Code Act, 1992 or the Building Code.

(2) Paragraphs 17 and 55 of the definition of “professional misconduct” in section 42 of the Regulations are revoked.

7. Section 46 of the Regulation is revoked.

8. (1) Paragraph 6 of section 49 of the Regulation is revoked.

(2) Paragraphs 7, 8 and 9 of section 49 of the Regulation are revoked and the following substituted:

7. Every holder of a licence, certificate of practice, certificate of practice issued under section 23 of the Act, and temporary licence shall keep the licence, certificate of practice or temporary licence, as the case may be, prominently displayed in the holder’s place of business.

8. Every member or holder shall present clearly to the member’s or holder’s employer or client the consequences that may be expected from any deviation in a design for which the member or holder is responsible in a case where the member’s or holder’s judgment is overruled by nontechnical authority.

(3) Section 49 of the Regulation is amended by adding the following paragraph:

11. Every holder and every member of the Association who is employed by a person who is not a holder must when submitting an application for a building permit include, with the information that is submitted, building code compliance data in accordance with Practice Bulletin A.9 published by the Association, revised December 17, 2004, accessible on the Association’s website, www.oaa.on.ca, and available in printed copies from the Association’s head office at 111 Moatfield Drive, Toronto, Ontario, M3B 3L6.

9. (1) Section 50 of the Regulation is amended by striking out “Building Code Act” in the portion before paragraph 1 and substituting “Building Code Act, 1992”.

(2) The definition of “design document” in paragraph 2 of section 50 of the Regulation is amended by striking out “the chief official as defined in the Building Code Act” and substituting “the chief building official as defined in the Building Code Act, 1992”.
