Amending Reg. 718 of R.R.O. 1990

(GENERAL)

1. Paragraph 4 of subsection 2.1 (2) of Regulation 718 of the Revised Regulations of Ontario, 1990 is amended by striking out “a government store operated by the manufacturer” and substituting “a store operated by the manufacturer to which an authorization under clause 3 (1) (e) of the Liquor Control Act applies”.

2. Section 4 is amended by striking out “the Schedule” wherever it appears and substituting in each case “Schedule 1”.

3. Section 11 of the Regulation is amended by striking out “or” at the end of clause (a) and by adding the following clause:

(a.1) under the supervision of a store employee in a store to which an authorization under clause 3 (1) (e) or (e.1) of the Liquor Control Act applies; or

4. Section 12 of the Regulation is amended by adding “and published on the website of the Alcohol and Gaming Commission of Ontario, as they are amended from time to time” at the end.

5. Subsection 13 (2) of the Regulation is revoked and the following substituted:

(2) Subsections 52 (1) and (2) of the Act do not apply to premises used as a store and operated by a manufacturer to which an authorization for the sale of Ontario wine under clause 3 (1) (e) of the Liquor Control Act applies if the store is located on premises used for the manufacture of Ontario wine.

6. Subsection 14 (1.1) of the Regulation is amended by striking out “section 20” and substituting “the condition in paragraph 2.2 of section 15”.

7. Paragraphs 1 and 2 of section 15 of the Regulation are revoked and the following substituted:

1. Subject to paragraph 2, the licence holder shall purchase liquor only from a government store or a store to which an authorization under clause 3 (1) (e) or (e.1) of the Liquor Control Act applies and only as agent for another person who is legally entitled to purchase liquor.

2. If the licence is held, directly or indirectly, by the operator of a store to which an authorization under clause 3 (1) (e.1) of the Liquor Control Act applies, the licence holder shall not purchase liquor from that store.

2.1 The licence holder shall not purchase liquor as described in paragraph 1 before receiving an order from a person who is legally entitled to purchase liquor.

2.2 The licence holder shall not, directly or indirectly, request, demand or receive any financial or non-monetary benefit in Ontario or in any other jurisdiction from a manufacturer of liquor, an operator of a store to which an authorization under clause 3 (1) (e) or (e.1) of the Liquor Control Act applies, or a representative or employee of such a manufacturer or operator.

2.3 The licence holder shall not purchase beer in packages with more than six containers from a government store, unless the government store is listed in Schedule 2.

8. Section 20 of the Regulation is revoked.

9. Clause 21 (2) (a) of the Regulation is revoked and the following substituted:

(a) state that the licence holder is licensed by the Alcohol and Gaming Commission of Ontario to deliver liquor to a person’s residence from a government store or a store to which an authorization under clause 3 (1) (e) or (e.1) of the Liquor Control Act applies, unless the licence conditions do not permit the licence holder to purchase liquor from the store;

10. Section 22 of the Regulation is amended by striking out “the Schedule” and substituting “Schedule 1”.

11. (1) Subsection 26.1 (1) of the Regulation is amended by striking out “the website of the Ministry of Consumer and Business Services (www.cbs.gov.on.ca/mcbs/english/pdf/warningsign.pdf)” and substituting “the website of the Alcohol and Gaming Commission of Ontario”.

(2) Subsection 26.1 (2) of the Regulation is amended by striking out “the website of the Ministry of Consumer and Business Services (www.cbs.gov.on.ca/mcbs/francais/pdf/warningsign_fr.pdf)” and substituting “the website of the Alcohol and Gaming Commission of Ontario”.

12. The title of the Schedule to the Regulation is revoked and the following substituted:

13. The Regulation is amended by adding the following Schedule:
