Amending O. Reg. 43/02

(EHEALTH ONTARIO)

1. The following provisions are amended by striking out “eHealth Services” and substituting “Digital Health Technology Services”:

1. The definition of “eHealth Services” in section 1.

2. Paragraph 1 of section 3.

3. Subsection 4 (7).

2. Section 1 of the Regulation is amended by adding the following definition:

“directive” means a directive issued by the Management Board of Cabinet;

3. Paragraph 2 of section 3 of the Regulation is revoked and the following substituted:

2. To develop operational policy for the provision of Digital Health Technology Services.  

4. Section 5 of the Regulation is revoked and the following substituted:

Memorandum of understanding

5. The Agency and the Minister shall enter into a memorandum of understanding and make it available to the public, and in doing so shall comply with any applicable directive.  

5. Subsection 6 (6) of the Regulation is amended by adding “or any other member or members who are public servants employed under Part III of the Public Service of Ontario Act, 2006” after “Ministry of Health and Long-Term Care”.

6. Subsection 8 (1) of the Regulation is amended by striking out “policy directions” and substituting “directions”.

7. (1) Subsection 10 (1) of the Regulation is revoked and the following substituted:

Annual report

10. (1) The Agency shall prepare an annual report on its affairs with respect to every fiscal year, provide it to the Minister and make it available to the public, and in doing so the Agency shall comply with any applicable directive.

(2) Subsection 10 (2) of the Regulation is amended by striking out “and” at the end of clause (a), by adding “and” at the end of clause (b) and by adding the following clause:

(c) any additional information requested by the Minister.

(3) Subsections 10 (3) and (4) of the Regulation are revoked and the following substituted:

(3) The Agency shall give the Minister such other information and reports on its affairs as the Minister may require.

8. Sections 10.1 and 10.2 of the Regulation are revoked and the following substituted:

Business Plan

10.1 The Agency shall prepare an annual business plan, provide it to the Minister and make it available to the public, and in doing so the Agency shall comply with any applicable directive.

9. Section 18 of the Regulation is amended by striking out “January 1, 2018” at the end and substituting “January 1, 2020”.

Commencement

10. This Regulation comes into force on the day it is filed.
