Amending O. Reg. 442/01

(RURAL OR REMOTE ELECTRICITY RATE PROTECTION)

1. Ontario Regulation 442/01 is amended by adding the following section:

Limitation period

11.1 (1) For the purposes of subsection 79 (4.4) of the Act, the limitation period that is applicable to consumers described in subsection 6 (2) of this Regulation is 24 months after the date of issuance of the invoice in which the rate protection was not provided to the consumer.

(2) For the purposes of subsection 79 (4.4) of the Act, the limitation period that is applicable to a distributor of a consumer described in subsection 6 (2) of this Regulation is six months after the earliest date when the distributor could have submitted a claim for reimbursement from the IESO for an amount of rate protection that the distributor provided to the consumer.

(3) In the event of a conflict between a limitation period referred to in subsection (2) and a limitation period provided for in section 36.1.1 of the Electricity Act, 1998, the limitation period that provides the longest time period for a claim to be made prevails.

Commencement

2. This Regulation comes into force on the later of July 1, 2023 and the day this Regulation is filed.
