Amending O. Reg. 176/10

(TEACHERS’ QUALIFICATIONS)

1. (1) The definition of “applicant” in subsection 1 (1) of Ontario Regulation 176/10 is amended by striking out “transitional” and substituting “transitional, multi-session transitional”.

(2) Subsection 1 (1) of the Regulation is amended by adding the following definition:

“multi-session transitional certificate of qualification and registration” means a certificate of qualification and registration referred to in paragraph 2.1 of section 2; (“certificat de qualification et d’inscription transitoire (programme en plusieurs parties)”)

(3) Subsection 1 (3) of the Regulation is amended by striking out “transitional” and substituting “transitional, multi-session transitional”.

2. The heading to Part II of the Regulation is revoked and the following substituted:

3. The heading before section 2 of the Regulation is revoked and the following substituted:

4. Section 2 of the Regulation is amended by adding the following paragraph:

2.1  Multi-session transitional certificates of qualification and registration.

5. Clause 4 (3) (f) of the Regulation is revoked and the following substituted:

(f)  in the case of an applicant for a multi-session transitional certificate of qualification and registration, a transcript indicating that the applicant has successfully completed the first session of a multi-session program of professional education, and other evidence satisfactory to the Registrar that the person has met the requirements for the certificate for which the applicant is applying;

(f.0.1) in the case of an applicant for a transitional certificate of qualification and registration,

(i)  a transcript indicating that the applicant has successfully completed in their program of professional education, other than a multi-session program of professional education,

(A)  a minimum of 30 post-secondary credits, or their equivalent, consisting of a combination of methodology and foundation courses that the Registrar considers to be appropriate, and

(B)  a minimum of 40 practicum days, and

(ii)  other evidence satisfactory to the Registrar that the person has met the requirements for the certificate for which the applicant is applying;

6. (1) Clause 5 (1) (g) of the Regulation is revoked and the following substituted:

(g)  in the case of an applicant for a multi-session transitional certificate of qualification and registration, a transcript indicating that the applicant has successfully completed one or more sessions of a program of professional education delivered over two or more sessions;

(g.0.1) in the case of an applicant for a transitional certificate of qualification and registration, a transcript indicating that the applicant has successfully completed in a program of professional education, other than a program of professional education delivered over two or more sessions,

(i)  a minimum of 30 post-secondary credits, or their equivalent, consisting of a combination of methodology and foundation courses that the Registrar considers to be appropriate, and

(ii)  a minimum of 40 practicum days;

(2) Subsection 5 (4) of the Regulation is amended by striking out “(g) or (g.1)” and substituting “(g), (g.01) or (g.1)”.

7. (1) Subsection 6.1 (2) of the Regulation is amended by striking out “or (2)”.

(2) Clause 6.1 (3) (d) of the Regulation is amended by striking out “or (2)”.

(3) Clause 6.1 (3) (g) of the Regulation is amended by striking out “transitional certificate” and substituting “transitional or multi-session transitional certificate”.

(4) Clause 6.1 (3) (h) of the Regulation is revoked.

(5) Clause 6.1 (3) (i) of the Regulation is amended by striking out “or (2)”.

8. (1) Subsection 6.2 (2) of the Regulation is amended by striking out “or (2)”.

(2) Clause 6.2 (3) (d) of the Regulation is amended by striking out “or (2)”.

(3) Clauses 6.2 (3) (g) and (g.0.1) of the Regulation are revoked and the following substituted:

(g)  if the previous certificate was a transitional or multi-session transitional certificate of qualification and registration, evidence satisfactory to the Registrar that the requirements of section 16, as they read on the day the certificate was granted, have been satisfied;

(4) Clause 6.2 (3) (h) of the Regulation is revoked.

(5) Clause 6.2 (3) (i) of the Regulation is amended by striking out “or (2)”.

9. Clause 10 (c) of the Regulation is amended by striking out “transitional” and substituting “transitional, multi-session transitional”.

10. (1) Clause 13.1 (2) (a) of the Regulation is amended by striking out “transitional” and substituting “transitional or multi-session transitional”.

(2) Subsection 13.1 (3) of the Regulation is revoked and the following substituted:

(3) For an applicant described in subsection 6.1 (2), the requirement under this subsection is that the applicant has satisfied any applicable terms, conditions or limitations described in clause 6.1 (3) (i) or (j).

11. (1) Clause 13.2 (2) (a) of the Regulation is amended by striking out “transitional” and substituting “transitional or multi-session transitional”.

(2) Subsection 13.2 (3) of the Regulation is revoked and the following substituted:

(3) For an applicant described in subsection 6.2 (2), the requirement under this subsection is that the applicant has satisfied any applicable terms, conditions or limitations described in clause 6.2 (3) (i) or (j).

12. The heading before section 14 of the Regulation is revoked and the following substituted:

Requirements for Transitional, Multi-session Transitional Certificates of Qualification and Registration

13. The Regulation is amended by adding the following section after the heading before section 14:

To whom transitional, multi-session transitional certificates may be granted

13.4 (1) The Registrar shall not grant a transitional certificate of qualification and registration under section 14 or 15,

(a)  in the case of an applicant under section 4, to an applicant enrolled in a multi-session program of professional education; and

(b)  in the case of an applicant under section 5, to an applicant enrolled in a program of professional education delivered over two or more sessions.

(2) The Registrar shall not grant a multi-session transitional certificate of qualification and registration under section 14 or 15,

(a)  in the case of an applicant under section 4, to an applicant enrolled in a program of professional education other than a multi-session program of professional education; and

(b)  in the case of an applicant under section 5, to an applicant enrolled in a program of professional education other than a program delivered over two or more sessions.

14. (1) Section 14 of the Regulation is amended by striking out “has successfully completed the first session of a multi-session program” wherever it appears and substituting in each case “satisfies the requirements set out in subsection (7) in respect of a program”.

(2) Subsection 14 (1) of the Regulation is revoked and the following substituted:

(1) Subject to section 13.4, the Registrar may grant to an applicant under section 4 a transitional or multi-session transitional certificate of qualification and registration if the Registrar has satisfactory evidence that,

(a)  the applicant has not previously held a transitional or multi-session transitional certificate of qualification and registration; and

(b)  the applicant has,

(i)  complied with sections 4 and 9, as applicable,

(ii)  met the requirements set out in subsection (2), (3), (4), (5) or (6), and

(iii)  paid all fees required under the by-laws for the issuance of the certificate.

(3) Section 14 of the Regulation is amended by adding the following subsections:

(7) For the purposes of clauses (2) (b), (3) (c), (4) (c), (5) (b) and (6) (b), one of the following requirements must be satisfied:

1.  In the case of an application for a multi-session transitional certificate of qualification and registration, the applicant has successfully completed the first session of a multi-session program of professional education.

2.  In the case of an application for a transitional certificate of qualification and registration, the applicant has successfully completed in their program of professional education other than a multi-session program of professional education,

(i)  a minimum of 30 post-secondary credits, or their equivalent, consisting of a combination of methodology and foundation courses that the Registrar considers to be appropriate, and

(ii)  a minimum of 40 practicum days.

(8) Despite clauses (2) (a), (3) (b) and (6) (a), an applicant is deemed to have satisfied the requirements set out in the applicable clause if the applicant is enrolled in a concurrent program and they submit evidence acceptable to the Registrar that they have completed the requirements for their post-secondary degree in a discipline other than education, whether or not that degree has been conferred.

15. Section 14.1 of the Regulation is revoked.

16. (1) Section 15 of the Regulation is amended by striking out the portion before clause (a) and substituting the following:

Applicants under s. 5

15.  Subject to section 13.4, the Registrar may grant to an applicant under section 5 a transitional or multi-session transitional certificate of registration if the Registrar has satisfactory evidence that,

. . . . .

(2) Subclause 15 (b) (i) of the Regulation is revoked and the following substituted:

(i)  that is equivalent to,

(A)  a multi-session transitional certificate of qualification and registration granted under section 14, in the case of an application for that class of certificate, or

(B)  a transitional certificate of qualification and registration granted under section 14, in the case of an application for that class of certificate, and

(3) Subclause 15 (b) (ii) of the Regulation is amended by striking out “that is delivered over two or more sessions”.

17. The Regulation is amended by adding the following section:

Term of transitional, multi-session transitional certificates of qualification and registration

15.1 (1) A transitional certificate of qualification and registration granted under section 14 or 15 is valid for 18 months.

(2) A multi-session transitional certificate of qualification and registration granted under section 14 or 15 is valid for six years.

18. Section 16 of the Regulation is revoked and the following substituted:

Conversion of transitional and multi-session transitional certificates

16. (1) The Registrar may grant to an applicant who holds a transitional or multi-session transitional certificate of qualification and registration under section 14 or 15 the corresponding general certificate of qualification and registration if the Registrar has satisfactory evidence that,

(a)  the applicant has successfully completed a practicum of a minimum of 80 days that meets the requirements set out in subsection 9 (2) of the accreditation regulation and has satisfied all other applicable conditions and requirements under the Act; and

(b)  the applicant has successfully completed the applicable program of professional education.

(2) For greater certainty, if a program of professional education mentioned in clause (1) (b) is a multi-session program of professional education, the applicant must have completed the final session of the program.

19. (1) Subsection 17 (1) of the Regulation is revoked and the following substituted:

(1) The Registrar may extend a transitional or multi-session transitional certificate of qualification and registration granted under section 14 or 15 for the period set out in subsection (3) or (4) if the Registrar has satisfactory evidence that the holder of the certificate is a member of the College in good standing and that at least one of the following criteria is met:

1.  The holder of the certificate has taken reasonable steps during the term of the certificate to complete their program of professional education.

2.  Exceptional circumstances are preventing the holder of the certificate from successfully completing their program of professional education before their certificate expires.

(2) Subsection 17 (2) of the Regulation is amended by striking out “transitional” and substituting “transitional or multi-session transitional”.

(3) Section 17 of the Regulation is amended by adding the following subsections:

(3) An extension of a transitional certificate of qualification and registration granted under subsection (1) is valid for six months.

(4) An extension of a multi-session transitional certificate of qualification and registration granted under subsection (1) is valid for one year.

20. The Regulation is amended by adding the following section before the heading that precedes section 17.1:

Completion of practicum

17.01 For the purposes of determining whether an applicant has successfully completed a practicum of a minimum of 80 days in a program of professional education, other than a multi-session program of education, each day, up to a maximum of 20 days, that an applicant teaches in accordance with a transitional certificate of qualification and registration shall be counted as one day of practicum, even if the teaching does not satisfy all the requirements for a practicum set out in subsection 9 (2) of the accreditation regulation.

21. Subsection 17.1 (1) of the Regulation is amended by striking out “a transitional certificate of qualification and registration or a temporary certificate of qualification and registration” and substituting “a transitional, multi-session transitional or temporary certificate of qualification and registration”.

22. (1) Section 18 of the Regulation is amended by striking out “transitional” wherever it appears and substituting in each case “transitional, multi-session transitional”.

(2) Subsection 18 (1) of the Regulation is amended by striking out “(5), (6), (8)”.

(3) Subsection 18 (3) of the Regulation is amended by striking out “or (5.1) of Ontario Regulation 271/19 (Proficiency in Mathematics) made under the Act”.

23. (1) Section 19 of the Regulation is amended by striking out “general, transitional” wherever it appears and substituting in each case “general, transitional, multi-session transitional”.

(2) Subclause 19 (1) (b) (ii) of the Regulation is revoked and the following substituted:

(ii)  In the case of a transitional certificate of qualification and registration, the program of professional education in which the applicant is enrolled and the areas of study in the applicant’s program of professional education.

(ii.1)  In the case of a multi-session transitional certificate of qualification and registration, the program of professional education in which the applicant is enrolled and in which the applicant has successfully completed the first session and the areas of study in the applicant’s program of professional education.

(3) Clause 19 (1) (f) of the Regulation is amended by striking out “general or transitional” and substituting “general, transitional or multi-session transitional”.

24. Subclause 26 (1) (b) (v) of the Regulation is amended by adding “Holocaust Education and Countering Antisemitism” after “Guidance and Career Education”.

25. Part IV of the Regulation is amended by adding the following section:

Persons who held transitional certificates on August 29, 2023

35.2 A person who, on August 29, 2023, held a transitional certificate of qualification and registration is deemed, on and after August 30, 2023, to hold a multi-session transitional certificate of qualification and registration with the same qualifications and subject to the same terms, conditions or limitations, if any.

26. Subsection 36 (2) of the Regulation is revoked.

27. (1) Subsections 37 (1), (2), (5), (6), (7) and (8) of the Regulation are revoked.

(2) Subsection 37 (12) of the Regulation is amended by striking out “subsection (5), (6), (8), (9)” and substituting “subsection (9)”.

28. Item 14 of the Table to section 50.0.1 of the French version of the Regulation is revoked and the following substituted:

29. Sections 50.3 and 50.4 of the Regulation are revoked and the following substituted:

Sexual abuse prevention program

Members who applied under s. 4 or 6 before January 1, 2022 and became a member after January 1, 2022

50.3 (1) A member who completed an application under section 4 or 6 before January 1, 2022 and became a member of the College after January 1, 2022 shall, on or before September 15, 2023,

(a)  complete the sexual abuse prevention program educational requirements referred to in subsection 47.2 (3) of the Act; and

(b)  provide evidence satisfactory to the Registrar that they have successfully completed the program.

30. (1) Schedule D to the Regulation is amended by adding “Holocaust Education and Countering Antisemitism”.

(2) Annexe D of the French version of the Regulation is amended by adding:

Commencement

31. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Subsections 7 (1), (2), (4) and (5), 8 (1), (2), (4) and (5), 10 (2), 11 (2) and 22 (2) and (3) and sections 24 and 26 to 30 come into force on the later of July 28, 2023 and the day this Regulation is filed.

(3) Sections 1 to 6, subsections 7 (3) and 8 (3), section 9, subsections 10 (1) and 11 (1), sections 12 to 21, subsection 22 (1) and sections 23 and 25 come into force on the later of August 30, 2023 and the day this Regulation is filed.
