Amending O. Reg. 365/22
(CODE OF ETHICS)
1. (1) Subsection 8 (1) of Ontario Regulation 365/22 is amended by striking out “A registrant shall promote” at the beginning and substituting “A registrant that represents a client shall promote”.
(2) Subsection 8 (2) of the Regulation is amended by striking out “If a registrant” at the beginning and substituting “If a registrant that represents a client”.
2. Section 9 of the Regulation is revoked and the following substituted:
Conscientious and competent service, etc.
9. (1) A registrant shall provide conscientious, courteous and responsive service to clients and demonstrate reasonable knowledge, skill, judgment and competence in providing such service.
(2) Subject to section 10, in carrying on business, a registrant shall demonstrate reasonable knowledge, skill, judgment and competence in providing opinions, advice, assistance or information to any person.
3. Section 13 of the Regulation is amended by striking out “shall not provide services, including representation, to a client” in the portion before clause (a) and substituting “shall not provide services to a client”.
Commencement
4. This Regulation comes into force on the later of the day subsection 31 (1) of the Trust in Real Estate Services Act, 2020 comes into force and the day this Regulation is filed.
