Amending O. Reg. 832/21

(HABITAT)

1. Ontario Regulation 832/21 is amended by adding the following section:

Black Ash habitat

5.1 (1) For the purpose of clause (a) of the definition of “habitat” in subsection 2 (1) of the Act, the areas described in subsection (2) of this section that are located in a municipality set out in Schedule 1 to Ontario Regulation 6/24 (LIMITATIONS ON SECTION 9 PROHIBITIONS) made under the Act are prescribed as the habitat of Black Ash.

(2) Subsection (1) applies to the areas within a radial distance of 30 metres from the stem of every Black Ash to which the prohibitions in clause 9 (1) (a) of the Act apply in accordance with Ontario Regulation 6/24.

Commencement

2.  This Regulation comes into force on the later of January 26, 2024 and the day this Regulation is filed.
