Amending O. Reg. 239/13

(ACTIVITIES ON PUBLIC LANDS AND SHORE LANDS - WORK PERMITS AND EXEMPTIONS)

1. (1) Subsection 8 (1) of Ontario Regulation 239/13 is amended by adding “Subject to subsection (2)” at the beginning.

(2) Subsection 8 (2) of the Regulation is revoked and the following substituted:

(2) The exemption under subsection (1) does not apply to shore lands or parts of shore lands located within the Lake Simcoe watershed boundaries as described in subsection 2 (1) of Ontario Regulation 219/09 (General) made under the Lake Simcoe Protection Act, 2008 unless the shore lands or parts of the shore lands are in an area described in paragraph 2 of subsection 28 (1) of the Conservation Authorities Act that is located within the area of jurisdiction of the Lake Simcoe Region Conservation Authority.

(3) The definition of “areas of jurisdiction of the Lake Simcoe Region Conservation Authority” in subsection 8 (7) of the Regulation is revoked.

(4) The definition of “Lake Simcoe watershed boundaries” in subsection 8 (7) of the Regulation is revoked.

Commencement

2. This Regulation comes into force on the later of the day section 25 of Schedule 4 to the Building Better Communities and Conserving Watersheds Act, 2017 comes into force and the day this Regulation is filed.
