Amending O. Reg. 282/13

(LIVING AND LEARNING GRANT)

1. (1) The portion before clause (a) in subsection 2 (1) of Ontario Regulation 282/13 is amended by adding “and before August 1, 2024” after “August 1, 2013”.

(2) The English version of subparagraph 1 i of subsection 2 (1.1) of the Regulation is amended by adding “or” at the end.

(3) Section 2 of the Regulation is amended by adding the following subsection:

(1.2) The Minister may make a Living and Learning Grant to an individual for a period of study commencing on or after August 1, 2024 if the individual satisfies the conditions set out in subsection (1.1) or one of the following conditions:

1.  The individual satisfies the conditions set out in clauses (1) (a) to (e.1) and clauses (g) to (i), and the individual is or will be 23, 24, 25 or 26 years of age as of the first day of the period of study for which the grant is needed.

2.  The individual provides the evidence described in subparagraph 1 i of subsection (1.1) and,

i.  the individual satisfies the conditions set out in subsection (1.1), except subparagraph 7 i, and

ii.  the individual is or will be 25 or 26 years of age as of the first day of the period of study for which the grant is needed.

3.  The individual provides the evidence described in subparagraph 1 ii of subsection (1.1) and,

i.  the individual satisfies the conditions set out in subsection (1.1), except subparagraph 8 i, and

ii.  the individual is or will be 21 or 22 years of age as of the first day of the period of study for which the grant is needed.

4.  The individual satisfies the conditions set out in subsection (1.1), except paragraphs 1, 7 and 8, and,

i.  provides evidence, as required by the Minister, that the individual is or will be eligible to receive continued care and support and that any of the circumstances set out in paragraphs 1, 2, 3 and 5 of subsection 54 (6) of Ontario Regulation 156/18 (General Matters Under the Authority of the Minister) made under the Child, Youth and Family Services Act, 2017 apply while receiving continued care and support,

ii.  is or will be 18, 19, 20, 21 or 22 years of age as of the first day of the period of study for which the grant is needed, and

iii.  is not ineligible for a grant or student loan under section 17 of the 2017 Regulation.

(4) Subsection 2 (2) of the Regulation is revoked and the following substituted:

(2) Despite clause (1) (f), subparagraphs 7 i and 8 i of subsection (1.1), paragraph 1 of subsection (1.2) and subparagraph 4 ii of subsection (1.2), an individual who reaches the age of 18 years, 21 years or 23 years, as the case may be, during the period of study for which the Living and Learning Grant is needed is, if otherwise eligible, eligible to receive the grant commencing the first day of the month following the month in which the individual turns 18, 21 or 23.

2. Clause 4 (a) of the Regulation is revoked and the following substituted:

(a)  received the grant pursuant to subsection 2 (1) or (1.1) and reaches the age of 25 during the period of study for which the grant is provided;

(a.1)  received the grant pursuant to paragraph 1 or 2 of subsection 2 (1.2) and reaches the age of 27 during the period of study for which the grant is provided;

Commencement

3. This Regulation comes into force on the day it is filed.
