Amending O. Reg. 167/95

(GENERAL)

1. Subsections 16 (4) and (5) of Ontario Regulation 167/95 are amended by striking out “three years” wherever it appears and substituting in each case “five years”.

2. Clause 17 (b) of the Regulation is amended by striking out “three years” in the portion before subclause (i) and substituting “five years”.

3. Section 26.1 of the Regulation is revoked and the following substituted:

26.1 (1) In this section,

“2020 Manual” means the Forest Management Planning Manual dated May, 2020 and referred to in subsection (4); (“Manuel de 2020”)

“2024 Manual” means the Forest Management Planning Manual dated March, 2024 and approved under subsection (2). (“Manuel de 2024”)

(2) The Forest Management Planning Manual prepared by the Ministry under paragraph 1 of subsection 68 (1) of the Act and dated March, 2024 is approved.

(3) The 2024 Manual applies to,

(a) forest management plans with effective dates that are on or after April 1, 2028; and

(b) forest management plans with effective dates that are before April 1, 2028, subject to the phase-in provisions set out in that Manual.

(4) The Forest Management Planning Manual prepared by the Ministry under paragraph 1 of subsection 68 (1) of the Act, dated May 2020 and previously approved under this Regulation continues to apply to forest management plans with effective dates that are before July 1, 2024, subject to the phase-in provisions set out in the 2024 Manual.

4. Section 26.2 of the Regulation is amended by striking out “May, 2020” and substituting “March, 2024”.

5. Section 28 of the Regulation is amended by striking out “October, 2017” and substituting “March, 2024”.

Commencement

6. This Regulation comes into force on the later of July 1, 2024 and the day this Regulation is filed.
