Amending O. Reg. 545/06

(ZONING BY-LAWS, HOLDING BY-LAWS AND INTERIM CONTROL BY-LAWS)

1. (1) Paragraph 1 of subsection 5 (3) of Ontario Regulation 545/06 is revoked and the following substituted:

1. Subsection (4), (7) or (7.1).

(2) Section 5 of the Regulation is amended by adding the following subsection:

(7.1) If, in the opinion of the clerk or the secretary-treasurer, a newspaper described in subsection (7) does not exist, notice shall be given by posting a notice on the website of the municipality or planning board.

(3) Subsection 5 (9) of the Regulation is amended by adding the following paragraphs:

19. A hospital, as defined in section 1 of the Public Hospitals Act, if the hospital is within one kilometre of any part of the land to which the proposed by-law would apply.

20. If a zoning regulation has been made under section 5.4 of the Aeronautics Act (Canada) with respect to lands adjacent to or in the vicinity of an airport, as defined in subsection 3 (1) of that Act, and if any part of those lands is within the land to which the proposed by-law would apply, the owner of the airport and, if the owner is not also the operator of the airport, the operator of the airport.

2. Subparagraph 5 i of subsection 6 (9) of the Regulation is revoked.

3. (1) Paragraph 1 of subsection 8 (1) of the Regulation is revoked and the following substituted:

1. Subsection (2), (2.1) or (3).

(2) Section 8 of the Regulation is amended by adding the following subsection:

(2.1) If, in the opinion of the clerk or the secretary-treasurer, a newspaper described in subsection (2) does not exist, notice shall be given by posting a notice on the website of the municipality or planning board.

4. (1) Paragraph 1 of subsection 9 (1) of the Regulation is revoked and the following substituted:

1. Subsection (2), (2.1) or (3).

(2) Section 9 of the Regulation is amended by adding the following subsection:

(2.1) If, in the opinion of the clerk or the secretary-treasurer, a newspaper described in subsection (2) does not exist, notice shall be given by posting a notice on the website of the municipality or planning board.

5. Section 10 of the Regulation is amended by adding the following subsection:

(4) For greater certainty, despite the amendments made to subsection 5 (9) of this Regulation by Ontario Regulation 286/24 made under the Act, subsection 5 (9) of this Regulation, as it read immediately before those amendments came into force, continues to apply in respect of a notice given under section 34 of the Act, if it was given to the persons and public bodies listed under subsection 5 (9) of this Regulation before the day Ontario Regulation 286/24 came into force.

Commencement

6. This Regulation comes into force on the later of July 1, 2024 and the day this Regulation is filed.
