Other objects of the IESO

1. (1) Without limiting the application of subsection (2), the objects listed in that subsection shall be read in a manner that is consistent with the views of the Government of Ontario that,

(a)  the United States of America is ignoring the rule of law in imposing unfair, unjustified and illegal tariffs on Canada;

(b)  the tariffs will have a negative impact on Ontario’s families, businesses and industries;

(c)  the tariffs pose an existential threat to hundreds of thousands of jobs and whole sectors of the Ontario economy, and will hurt communities throughout the Province;

(d)  in response to the tariffs, Ontario is taking appropriate and proportional actions to defend the essential energy and economic security of Ontario and to keep Ontario safe; and

(e)  Ontario must ensure that the IESO-controlled grid is reliable and secure for Ontarians.

(2) In addition to the objects prescribed in section 1 of Ontario Regulation 288/14 (Other Objects, IESO) made under the Act, the following are other objects of the IESO for the purposes of clause 6 (1) (s) of the Act:

1.  To engage in activities in response to unjustified tariffs imposed on Ontario goods by the United States of America, including implementing measures to discourage the transmission of electricity to the United States of America and to prioritize the efficient and sustainable use of Ontario’s electricity resources for Ontarians.

2.  To implement a surcharge on the transmission of electricity to the United States of America.

3.  To engage in activities to protect Ontarians, Ontario’s economy, and the essential energy and economic security of Ontario from negative impacts arising from unjustified tariffs imposed on Ontario goods by the United States of America.

4.  To pursue the objects in paragraphs 1, 2 and 3 in furtherance of the policies of the Government of Ontario.

Reason for urgent amendment, s. 34 (1) of the Act

2. In addition to the reasons prescribed in section 9 of Ontario Regulation 610/98 (The IESO) made under the Act, the following additional reason is prescribed for the purpose of paragraph 5 of subsection 34 (1) of the Act:

1.  To implement measures in response to tariffs imposed on Ontario goods by the United States of America, including implementing a surcharge on the transmission of electricity to the United States of America.

3. This Regulation comes into force on the later of March 10, 2025 and the day this Regulation is filed.
