On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas, Order in Council O.C.  2450/2017, which authorized the establishment of the Ontario Energy Board (“OEB”) Modernization Review Panel to support a modernization review of the OEB and provide advice and recommendations to the Minister of Energy in this regard, was revoked, effective June 29, 2018 pursuant to Order in Council O.C. 988/2018;

And whereas the Government of Ontario is committed to enhancing consumer confidence in the energy sector in order to improve decision-making, increase efficiencies, and promote best value;

And whereas the Government of Ontario recognizes that the OEB, the energy sector’s independent regulator, will play a critical role with respect to this commitment, and accordingly it will be important to assess the OEB’s current governance and operational framework in supporting this commitment;

And whereas, the Government of Ontario accordingly wishes to establish a new panel to support a review of the governance and operational framework of the OEB and provide advice and recommendations to the Minister of Energy, Northern Development and Mines (the “Minister”) in this regard;

Therefore, pursuant to subparagraph 12(1)(a) of the Ministry of Energy Act, 2011, the Ontario Energy Board Modernization Review Panel (the “Panel”) is hereby established as a short-term advisory body as of the date of this Order and as follows,

Panel established for four (4) months

  1. The Panel is hereby established as a short-term advisory body, accountable to the Minister, for a period of four (4) months from the date of this Order.

Terms of reference

  1. The Minister shall determine the terms of reference for the Panel, and may amend them from time to time.

Appointments to the Panel

  1. The Panel shall be comprised of three (3) members to be appointed by the Minister, and the Minister shall designate one (1) member as Chair.
  2. The members of the Panel, including the Chair, shall serve at the Minister’s pleasure for a period not exceeding four (4) months from the date of this Order.

Remuneration

  1. The members of the Panel, including the Chair, shall be paid such remuneration and expenses as the Lieutenant Governor in Council may determine.
