On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to subsection 2(1) of the Executive Council Act, a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Northern Development, Mines, Natural Resources and Forestry;

Therefore pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act:

Minister to preside over Ministry

  1. The Minister of Northern Development, Mines, Natural Resources and Forestry (the “Minister”) shall preside over a ministry known as the Ministry of Northern Development, Mines, Natural Resources and Forestry (the “Ministry”).

Minister

  1. The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of northern development, mines, natural resources, forestry and any other matters related to the Minister’s portfolio.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities in respect of northern development and mines that had previously been assigned and transferred to the Minister of Energy, Northern Development and Mines under Order in Council O.C. 1148/2018 dated October 22, 2018, as amended, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly.
  3. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had been previously assigned and transferred to the Minister of Natural Resources and Forestry under Order in Council O.C. 1158/2018 dated October 22, 2018, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. These include but are not limited to the powers, duties, functions and responsibilities of the Minister of Natural Resources in respect of the following Acts:
    1. Conservation Land Act
    2. Fish and Wildlife Conservation Act, 1997
    3. Fisheries Loans Act
    4. Forest Fires Prevention Act
    5. Forestry Act
    6. Lakes and Rivers Improvement Act
    7. Ministry of Natural Resources Act except in respect of sections 7, 9, and 12 as they can be applied to support the powers, duties, functions and responsibilities of the Minister of the Environment, Conservation and Parks related to conservation authorities, provincial parks, conservation reserves and species at risk
    8. North Georgian Bay Recreational Reserve Act, 1962-3
    9. OilGas and Salt Resources Act
    10. Ontario Geographic Names Board Act
    11. Professional Foresters Act, 2000
    12. Public Lands Act
    13. Seine River Diversion Act, 1952
    14. Surveys Act
    15. Wild Rice Harvesting Act
    16. Wilderness Areas Act
  4. The Minister shall exercise the powers and perform the duties, functions and responsibilities under the Conservation Authorities Act in respect of:
    1. clause 13.1(6)(b) as it applies to flood control
    2. clause 21(1)(o)
    3. section 23
    4. subsection 24(1) as it applies to projects that relate to the management and control of natural hazards
    5. section 24 as it applies to projects that relate to the management and control of natural hazards on and after the date that section comes into force
    6. section 28 as it applies to matters that relate to the management and control of natural hazards
    7. section 28.0.1
    8. sections 28 to 28.4 on and after the date those provisions come into force
    9. subsection 32(1)
    10. subsection 40(4).
  5. The Minister may exercise any of the other powers and perform any of the other duties, functions and responsibilities under the Conservation Authorities Act which can be applied to support the powers, duties, functions and responsibilities assigned to the Minister under paragraph 5 of this Order in Council including, but not limited to the hearing of appeals under subsection 30.4(9).

Ministry

  1. The Ministry shall carry out the functions, responsibilities and programs that are assigned by law to the Ministry or that may otherwise be assigned to or undertaken by the Ministry in respect of northern development, mines, natural resources, forestry and any other matters related to the Minister’s portfolio.
  2. The Ministry shall carry out the functions, responsibilities and programs in respect of northern development and mines that had been previously assigned and transferred to the Ministry of Energy, Northern Development and Mines under Order in Council O.C. 1148/2018 dated October 22, 2018, as amended, and such functions, responsibilities and programs are assigned and transferred to the Ministry accordingly. These include but are not limited to the functions, responsibilities and programs of the Ministry of Northern Development, Mines and Forestry under the Ministry of Northern Development, Mines and Forestry Act.
  3. The Ministry shall carry out the functions, responsibilities and programs that had been previously assigned and transferred to the Ministry of Natural Resources and Forestry under Order in Council O.C. 1158/2018 dated October 22, 2018, and such functions, responsibilities and programs are assigned and transferred to the Ministry accordingly, including, but not limited to the functions, responsibilities and programs of the Ministry of Natural Resources in respect of the following Acts:
    1. Fish and Wildlife Conservation Act, 1997
    2. Forest Fires Prevention Act
    3. Forestry Act
    4. Lakes and Rivers Improvement Act
    5. Ministry of Natural Resources Act except in respect of sections 7, 9, and 12 as they can be applied to support the functions, responsibilities and programs of the Ministry of the Environment, Conservation and Parks related to conservation authorities, provincial parks, conservation reserves and species at risk
    6. Oil, Gas and Salt Resources Act
    7. Public Lands Act
    8. Surveys Act
  4. The Ministry shall carry out the functions, responsibilities and programs under the Conservation Authorities Act in respect of:
    1. clause 13.1(6)(b) as it applies to flood control
    2. clause 21(1)(o)
    3. section 23
    4. subsection 24(1) as it applies to projects that relate to the management and control of natural hazards
    5. section 24 as it applies to projects that relate to the management and control of natural hazards on and after the date that section comes into force
    6. section 28 as it applies to matters that relate to the management and control of natural hazards
    7. section 28.0.1
    8. sections 28 to 28.4 on and after the date those provisions come into force
    9. subsection 32(1)
    10. subsection 40(4).
  5. The Ministry may carry out the functions, responsibilities and programs under any of the provisions of the Conservation Authorities Act which can be applied to support the functions, responsibilities and programs assigned to the Ministry under paragraph 10 of this Order in Council including, but not limited to those related to the hearing of appeals under subsection 30.4(9).

Administration of statutes

  1. Despite any provision of a statute or Order in Council, the administration of the statutes set out in the Appendix to this Order in Council is assigned to the Minister.

Revocation of Order in Council

  1. Order in Council O.C. 1158/2018 dated October 22, 2018 is hereby revoked.

Amendments to Order in Council

  1. Order in Council O.C. 1149/2018 dated October 22, 2018 is hereby amended as follows:
    1. Subparagraphs 4 (a) – (g) are revoked and the following substituted:
      1. clause 13.1(6)(b) as it applies to flood control
      2. clause 21(1)(o)
      3. section 23
      4. subsection 24(1) as it applies to projects that relate to the management and control of natural hazards
      5. section 24 as it applies to projects that relate to the management and control of natural hazards on and after the date that section comes into force
      6. section 28 as it applies to matters that relate to the management and control of natural hazards
      7. section 28.0.1
      8. sections 28 to 28.4 on and after the date those provisions come into force
      9. subsection 32(1)
      10. subsection 40(4)

      “Conservation Authorities Act, except in respect of clause 13.1 (6) (b) as it applies to flood control, clause 21 (1) (o), section 23, section 28 as it applies to matters that relate to the management and control of natural hazards, and subsection 32 (1 ), as well as in respect of sections 28 to 28.4 and clauses 40 (3) (e), (f), (g) and (h) on and after the date those provisions come into force”

      and substituting:

      "Conservation Authorities Act except in respect of clause 13.1(6)(b) as it applies to flood control, clause 21(1)(o), section 23, subsection 24(1) as it applies to projects that relate to the management and control of natural hazards, section 28 as it applies to matters that relate to the management and control of natural hazards, section 28.0.1, subsection 32(1) and subsection 40(4), as well as in respect of section 24 as it applies to projects that relate to the management and control of natural hazards and sections 28 to 28.4 and on and after the date those provisions come into force”

    5. The Appendix is further amended by striking out:

      Endangered Species Act, 2007, except in respect subsection 54 (2), which is shared with the Minister of Natural Resources and Forestry”

      and substituting:

      Endangered Species Act, 2007
