Order in Council 1078/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas subsection 2(2) of the Building Code Act, 1992 provides that there shall be a Director of the Building and Development Branch of the Ministry of Municipal Affairs and Housing who is appointed by the Lieutenant Governor in Council;

And Whereas a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Municipal Affairs pursuant to subsection 2(1) of the Executive Council Act;

And Whereas the Minister of Municipal Affairs has been assigned responsibility for presiding over a ministry known as the Ministry of Municipal Affairs by Order in Council O.C. 1207/2016 dated August 4, 2016;

And Whereas the Minister of Municipal Affairs has been assigned responsibility for administration of the Building Code Act, 1992 by Order in Council O.C. 1207/2016 dated August 4, 2016;

And Whereas pursuant to Order in Council O.C. 1207/2016 dated August 4, 2016, the Ministry of Municipal Affairs has been assigned responsibility for carrying out the functions, responsibilities and programs that had been previously carried out by the Ministry of Municipal Affairs and Housing under Order in Council O.C. 221/2015 dated February 18, 2015 in respect of the Building Code Act, 1992;

And Whereas clause 77(b) of the Legislation Act, 2006 provides that the power to appoint a person to a public office includes power to appoint a deputy with the same powers as the holder of the office, subject to specified conditions, or with limited powers as specified;

And Whereas James Douglas was appointed the deputy of the Director of the Building and Development Branch by Order in Council O.C. 420/2012 dated April 4, 2012;

Therefore Pursuant to subsection 2(2) of the Building Code Act, 1992 and clauses 77(a) and (b) of the Legislation Act, 2006:

Appointment of deputy of the Director

1. Brenda Lewis of Barrie, Ontario is hereby appointed the deputy of the Director of the Building and Development Branch.

Revocation of Order in Council

2. Order in Council O.C. 420/2012 dated April 4, 2012 is hereby revoked.
